사회가 발전해 가면서 우리 사회에서 문제가 되고 있는 것은 소년비행 내지 소년범죄일 것이다. 소년범죄의 문제는 갈수록 흉악해지고 저연령화 등의 현상을 나타내고 있어 각국에서 이에 대한 적절한 형사제재 수단을 강구하기 위한 그 방법을 찾고 있는 실정에 있다. 본 연구에서는 이러한 문제의식을 가지고서 접근하여 범죄백서 등의 자료분석을 통하여 소년비행의 추이를 분석하여 보고 개선되어야 할 시사점을 제시하고자 한다. 먼저 소년비행의 실태와 더불어 보호 관찰제도에 대한 개념적 접근을 통하여 협의의 개념을 넘어서서 사회봉사명령이나 수강명령 제도를 살펴보았고, 다음으로 최근에 소년법상의 개정내용을 포함하여 현행 형사절차에서 비행소년에 대한 보호관찰제도가 어떻게 이루어지고 있는가를 보여주고 있다. 마지막으로 소년비행에 초점을 맞추어 우리나라 실정에 적합한 보호관찰제도에 대한 방향성 내지 시사점을 제시하고자 한다.

In Present times there are more becoming ferocity, systematization and sophisticated forms. Generally the Probation system is Criminal Law, which is that the offender will be able to free activity in social communication by punishment's suspended sentence or sentence and suspension of execution. Also, there are various interpretation on the legal characteristics of the probation system and the probation system includes the community service order, attendance center order etc. The juvenile probation system is considered to be the best policy for the treatment of juvenile offenders among the policies until now and the criminals can be educated and guided under the direction and supervision of the probation officers under the community service order or under the attendance center order etc. This study is to show the most effective method to maximise the beneficial effects for juvenile probation system in Korea.
