발달장애범죄인에 대한 교정이념은 「장애인 차별금지 및 권리구제 등에 관한 법률」 (이하 “장애인차별금지법”이라 한다)과 「발달장애인 권리보장 및 지원에 관한 법률」 (이하“발달장애인법”이라 한다)에 맞게 발달장애인의 특성과 정도를 고려한 교정공공 재의 생산(교화와 건전한 사회복귀)으로 규정된다. 그러나 과거의 시혜적인 잔여적 (residual) 사회복지의 영향을 받아 온 「형의 집행 및 수용자의 처우에 관한 법률」(이하 “형집행법”이라 한다) 에서는 발달장애수용자에 대한 교정처우에서 발달장애의 특성을 고려한 교정처우가 전혀 되지 않고 있으며 그 결과 발달장애수용자의 교화와 사회복 귀는 형해화되었다. 발달장애수용자에 대한 적절한 교화를 위해서는 장애학이념과 발 달장애인법 및 장애인차별금지법의 이념을 발달장애의 특성에 맞게 교정처우에 반영 하고 발달장애수용자의 처우의 개별화가 이루어져야 한다. 발달장애인의 범죄와 관련 해서는 수사단계에서의 매뉴얼이 있어 수사과정에서는 발달장애의 특성이 고려된 사 법절차가 되고 있지만 발달장애수용자에 대한 교정처우에 관한 매뉴얼과 관련 선행연구가 없어 발달장애수용자는 그에 맞는 교정복지처우가 되지 않고 있다. 따라서 본 논 문에서는 사회적 형평이념 및 장애인차별금지법의 취지에 맞게 발달장애수용자에 대한 교정처우의 문제점과 개선방안을 학제적 방법으로 접근하여 발달장애수용자에 대한 교정이념의 방향으로 교정복지이념의 적용을 제시했다.

Correctional welfare treatment for criminals(inmates) with developmental disability is defined as the production of correctional public service considering the characteristics of people with developmental disabilities in conformity with the laws of developmental disability and the act on the prevention of discrimination against the disabled. But, Korean act of penal execution and correctional treatment under the influence of the residual welfare of the past has not treated in consideration of the characteristics of inmate with developmental disabilities in correcting for them and correction for them has become perfunctory. The individualization of treatment for inmates with developmental disabilities should be done in consideration of their characteristics under ideology of laws of developmental disability and act on the prevention of discrimination against the disabled for adequate correcting for them. The characteristic of developmental disability is considered in the judicial process and the investigation stage because there is a manual on crime about developmental disability at the investigation stage. But, the correction welfare treatment does not match the characteristics of the inmates of developmental disability because there is no manual and existing studies on developmental disability inmate in correcting them in prison. Therefore, I asserted the desirable direction on correction welfare treatment for them throughout the interdisciplinary aspect in conformity with the purpose of social equilibrium ideology and act on the prevention of discrimination against the disabled.
