저작권의 특수성과 형사책임제한 - Copyright Troll문제를 중심으로 -

‘저작권’은 지적재산권 중에서도 가장 침해에 취약한 권리로 꼽힌다. 우리나라 역시 과거에는 저작권의 보호수준이 매우 열악하였으나, 국제협약에 가입하고 관련 법제 및 판례 등을 통하여 지속적으로 이를 강화해왔다. 그런데 오히려 저작권 보호가 강화되자 저작권을 악용하는 ‘Copyright Troll’문제가 대두되었다. 이들은 전략적으로 저작권을 수집하거나 저작권침해를 방조하여 형사 고소를 통해 피고의 개인정보를 수사기관에 촉탁하여 수집한 뒤 민사소송 및 형사소송을 진행하며 합의금을 요구한다. 이는 특허권⋅상표권⋅저작권 전반에서 공통적으로 나타나는 ‘Troll’의 문제이나, 특허권⋅상표권은 원칙적으로 독점권이 부여되는 등록하는 권리인데 비해 저작권은 비등록권리이며 대중들의 이용을 전제하는 권리라는 점, Copyright Troll의 주 타깃 역시도 일반 대중이라는 점에서 특수성을 가진다.
Copyright Troll의 유형은 ①저작재산권을 양수하거나 독점적 이용허락을 전략적으로 축적하여 소송을 수행하는 회사, ②형사고발로 위협하여 합의금을 취하는 저작권대리중개업체, ③저작권자로부터 소송수행권을 위임받은 회사로 구분할 수 있다.
기존의 Copyright Troll 규제논의는 주로 저작권법상 형사처벌조항과 관련하여 이루어졌다. 경미한 저작권법 침해 행위에 대하여는 형사처벌 을 제한하거나 저작권자의 고소가 있어야 처벌이 가능한 친고죄로 개정하여 저작권 없는 대리업체의 고발남용을 막는 것에 대한 입법안이 있어왔다. 또한 저작권 침해행위의 고의를 ‘중대한 고의’ 로 제한하는 해석론도 있었다.
최근 법원은 보다 전향적인 판결을 내리고 있다. 미국 법원은 Copyright Troll의 정보제공신청을 기각하고 Copyright Troll에 대한 징벌적 손해배상을 인정하며 이들의 사업 방식에 제동을 걸었다. 또한 속칭 ‘합의금 장사’를 위해 형식적인 저작권 양수계약을 체결한 것만으로는 저작권 자로 인정할 수 없다하여 저작권 침해 소송에서 당사자적격을 부정한바 있다. 우리나라 법원 역시 비슷한 논리로 ‘합의금 장사’와 같은 기획소송에 대해 소권남용으로 각하판결을 내렸다.
본 논문은 Copyright Troll의 유형 중 거의 존재하지 않는 ①유형의 논의는 생략하고, ②③유형을 중심으로 구체적 규제방안을 살폈다. 먼저, ② 유형의 경우, 저작권법의 공정이용조항 및 그 취지를 고려하여 영리성을 부정해 친고죄로 해석하 는 방식으로 형사처벌의 제한이 가능하고, ③유형의 경우, 공정거래법상 규제 및 저작권 남용이론 및 형사처벌제한을 통하여 그 행위를 제한할 수 있을 것으로 보인다. 저작권법은 ‘저작권 보호’를 통한 창작촉진과 ‘공정이용’이라는 두 가지 목적을 가진다.
저작권은 보호되어야 하는 권리인 동시에 이용되어야 하는 권리이다. 저작권법에 존재하는 모든 법리들 은 최종적으로 저작권법이 추구하는 목적을 위해 존재하는 것이고, 저작권 침해행위에 대한 제재규정 역시 동법의 목적추구를 위한 하나의 중요한 도구이다. 따라서 이를 악용하여 오히려 저작권법의 목적을 해하는 역기능이 나타난다면 제도적 개선, 해석론의 다양화가 이뤄져야 한다. 본 논문에서 제시한 해석론을 포함한 법제개선으로 Copyright Troll의 규제가 이뤄지기를 기대한다.

Copyright is considered the most vulnerable intellectual property right. Although the level of copyright protection in Korea was very poor in the past, it has been steadily reinforced through the registration of international treaties and related laws and cases. However, as copyright protection was strengthened, the “Copyright Troll” problem arose. They collect copyright strategically. Then, they file civil and criminal lawsuits against intruders and ask for settlement money. This is a common issue of ‘Troll’ across patents, trademarks and copyrights. While patent and trademark rights are, in principle, exclusive rights to register, copyright is a non-registered right and a right that assumes the public’s use. The main target of the Copyright Troll is also distinguished in that it is the general public.
The types of Copyright Troll are ①company that strategically collects copyrights and goes to court, ②copyright broker and ③company commissioned to carry out lawsuits by copyright holders.
The Copyright Troll debate was conducted on criminal penalties under the Copyright Act. There was a bill that limited criminal penalties for minor infringement of copyright law. There was a bill that limited the provision of criminal punishment to juvenile delinquents for criminal charges. There was an interpretation that limited the intent of copyright infringement to ‘serious intent’.
A U.S. court recently turned down Copyright Troll’s application for information. The U.S. court also recognized punitive damages against the Copyright Troll. It also denied any party eligibility in its copyright infringement suit for the commonly term ‘bonding business’. South Korea’s court also dismissed lawsuits such as the “bonding business” as abuse of power.
Copyright Troll of type 2 can limit criminal punishment by interpreting its commerciality as a pro-consultation charge, considering the use of the process and its intent. Type 3 can limit its activities through regulations under the Fair Trade Act and the theory of copyright abuse and criminal penalties.
