        해양경계획정에 대한 국가들의 시도는 분쟁당사국 간의 합의, 국제재판소의 사법적 판결로써 일반적인 흐름을 형성해왔다. 이것은 법의 유권적 해석에 관 한 정형화된 절차 또는 기관이 확정되어 있는 국내법과는 달리 국제법에 있어서는 ICJ, ITLOS 또는 중재법원의 결정들이 국제법의 해석에 관한 한 가장 권 위적이고 결정적인 것으로서 받아들여지고 있기 때문이다. 다만 국제재판소의 재판의 준칙이 되어야 할 유엔해양법협약(UNCLOS)의 관련 규정은 해양경계획정의 목적이 ‘형평한 해결’에 있다는 것만 밝히고 있을 뿐 그 방법이나 고려해야할 관련사정 등에 대해서는 구체적인 기준을 제시하지 않고 있기 때문에, 해양경계획정문제는 아직까지 관련당사국들의 상이한 주장에 맡겨진 채 쉽게 해결에 이르지 못하고 있다. 더욱이 해양경계획정의 각 사건은 독특한 혹은 독자적인 것으로서 ‘선례구속의 원칙(Doctrine of stare decisis)’이 인정되지 않기 때문에 이들 판례로부터 일반적인 법원칙을 도출해 내는 것은 매우 어려운 일이었다. 그럼에도 불구하고 국제재판소가 자신의 선 판례를 존중하는 입장을 취하면서 후속 사건의 판단기준으로 인용하고 있다는 점은 주목 할 만하다. 이러한 관점에서 그동안 축적되어온 국제 판례상의 해양경계획정원칙과 방법, 관련사정 등을 종합적으로 검토함으로써 해양경계획정문제에 적용할 수 있는 일반적 규칙을 도출하고 이러한 규칙에 따라 경계획정을 권고하는 방안을 검토해 나가는 것은 실익이 있다고 판단된다. 다만 유엔해양법협약의 개정이 현실적으로 매우 어려운 점을 감안하여 국제 판례의 리스테이트먼트 작업을 통한 법적 정리 및 국제적 권고 수준의 가이드라인 제정방식을 제안하고자 한다. 무엇보다도 오늘날 해양권익의 확대에 따라 국가 간의 명확하고 신속한 경계획정이 우선적으로 요청된다는 점을 상기하면서, 국가들은 구체적인 해양경계획 정방법을 고안하는데 협력하여야 한다.

        This article is focused on strategies and implementation of Correctional Classification by using scientific approaches, individualization, and socialization. Correctional classification is based on era's opinion and the basic corrections philosophy that has existed throughout our penal history. At the beginning of our correctional history, 'classification' only meant in practice the prisons responsibility to carry out the sentences ordered by the courts. However in the 20th century, 'classification' had to consider an increase in the crime rate, over crowded prisons, cost management and the uncertain success rate of the rehabilitation model to re-examine the role of Correctional Classification System. Correctional Classification can also be a valuable asset in justifying the governing body's action when different correctional treatments are given to those with identical crimes. In the development of classifying the criminals and the advents of individualism, humanism, and scientific methods, Objective Correctional Classification Strategies has come to the spot light. This Classification Strategy will reduce human errors in treatments by forbidding a governing individual from practicing personal experience and intuition on determining the treatment. Instead, scientific and objective Correctional Classification Strategies, with help of criminology and psychology, will prove to be effective in treating inmates fairly, delegating the resources, and cost of management. General purposes of corrections are maintenance of inmates, effective of efficient treatment, humanity, and security. Classification Strategies for Clarification of Correctional ideas are as follow; ․ Analysis and evaluations of current classification systems. ․ Development of proper and adequate treatments of rehabilitation programs. ․ Development of efficient infrastructure and facilities.

        본 연구는 제품디자인의 콘셉트 개발에 있어서 개념적이며 비시각적인 콘셉트를 플랫폼 기반의 구조적 접 근을 통해 구체화시키고, 디자인 경영자원의 분배와 활용에 대한 전략적 구조로써 플랫폼의 효용성 제고(提 高)를 통해 향후 디자인 경영자원의 분배에 대한 전개방향을 제시하는 것에 목적이 있다. 이를 위해 디자인 콘셉트가 어떻게 적용되었는지 제품디자인의 유형별 사례조사를 실시하였고, 디자인 콘셉트가 구체화 된 사례에 따라 분류 하였다. 이 분류 된 사례를 통하여 플랫폼의 구조를 정의 하였다. 사례 연구를 통해서, 디 자인 콘셉트는 플랫폼 기반의 다양한 구조를 통하여 구체화 되고, 구조화 된 플랫폼을 통하여 계획 된 기업 또는 제품의 아이덴티티가 형성된다는 것을 알 수 있었다. 따라서 기업의 경영철학, 슬로건, 심볼, 서비스, 기술력, 디자인 등의 세분화 된 플랫폼 기반의 제품디자인에 서는 디자인 경영자원을 계획하고 부서간이나 프로젝트에 따른 동일한 분배보다는 기업 전략에 따른 선택 과 집중을 위한 합리적이고 효율적 분배가 적절하게 이루어 져야 할 것이다.

        Causation in the Criminal Law is very important as it is a part of an element of a crime, especially result crime. Where an accused is charged with a result crime, it is necessary for the prosecution to prove that her act or omission caused the prohibited consequence.Traditionally speaking, there has been several theories to solve the problem of causation. One is a ‘sine qua non’ or ‘but for’ theory, which must be established that the consequence would not have occurred when it did ‘but for’ the accused’s conduct. But the sine qua non theory is said to be not sufficient for it’s ambit is too wide to establish the causation. So comes an ‘adequacy’ theory, which means that when a prohibited consequence occurs whether the relation between the cause in question and the consequence is adequate or reasonable. For a long time the adequacy theory has been the majority in theory and cases in Korea. But nowadays a new theory has appeared before 25 years ago from the German Criminal Law, which is called ‘objective attribution’ theory. It is getting and getting common here. Objective attribution theory means that a prohibited consequence comes from the cause in question.However, even though objective theory is popular among the scholars, adequacy theory is the majority in the criminal cases because of the Japanese criminal law theory. But it has been attacked by some scholars because the meaning of adequacy is somehow abstract or obscure. To overcome the problems of the adequacy theory, it must settle a new way of reasoning. As a one reasoning, there comes so-called ‘Fright and Flight’ theory in Anglo-American Criminal Law. It seems to solve the problems of adequacy theory.

        T. S. Eliot has woven into the fabric of Four Quartets themes and symbols from a variety of Christian and non-Christian mystical sources. One of the powerful mystical elements is derived from the 16th century Spanish mystic, St. John of the Cross, whose spiritual exercises stand for the Negative Way. In the Western theology, there are two distinctive ways in which Christian saints or poets can perceive the Divine Reality. They are the Affirmative Way and the Negative Way. The Affirmative Way is the same idea with the doctrine or poetry of immanence, and the Negative Way with the doctrine or poetry of transcendence. T. S. Eliot's poetry is influenced by the tradition of the Negative Way or the poetry of transcendence. This thesis intends to study what characteristics the Affirmative Way or the Negative Way respectively has, and what is the theory of St. John's dark night of the soul. Also it wishes to trace which elements Eliot took from St. John and which elements he refused to take. Finally, in his masterpiece Four Quartets, this study will observe how St. John's negative theology is crystallized into the inner structure of the poem. Also this thesis wishes to reveal in what sense Eliot's poetry can be named the poetry of transcendence. Hopkins perceives the unity of nature, a poet and God, therefore he depicts the nature like "The world is charged with the grandeur of God." But Eliot is not eager to perceive the immanent presence of God in the power and beauty of nature. Instead, the poet is evoked with partial ecstasy and partial dread and goes through purgation process and afterwards reaches self-oblivion or union with God. In Eliot's idiom, he wishes to "go by a way wherein there is no ecstasy." In "Burnt Norton" III and "East Coker" III Eliot gives powerful expression to St. John's Negative Way. In these parts Eliot tries to apply St. John's theory, which was, originally, individual way of spiritual exercises, to diagnosing the collective spiritual darkness of modern London. Eliot seems to declare such a modern society must pass through the painful self-negation and complete deprivation, as shown in St. John's Negative Way. According to John X. Cooper, such idea of Eliot's is possibly true, because if the individual purification cannot bring us back from the abyss, the mere social world can hold absolutely no hope. We can hear Eliot's prophetic voice saying that after descending to the bottom and confronting the absolute solitude and abyss, the soul can arise from the dark night of purgation towards the world of light. Four Quartets, however, remains first and foremost a poem not a poetic version of mystical theology. Although Eliot alludes to and even paraphrases St. John's dark night of the soul, St. John's negative theology can be only one of the powerful threads in Eliot's poetical fabric.
