현행 제6공화국 헌법은 통치구조의 조직과 구성 면에서 권력분립의 원리가 비교적 잘 반영되어 있는 민주법치국가 헌법으로 평가를 받는다. 현행 헌법이 시행된 이후 정치 영역인 입법부와 행정부 부문에서는 민주주의 원리를 구현하기 위한 다양한 노력이 꾸준히 전개되었고 상당한 성과도 거두었다. 정치 영역에서 일정한 성과를 달성하게 되자 사법부의 민주개혁을 갈망하는 국민의 여론이 높아졌다. 국민의 사법부 민주개혁 여론은 대법원장의 권한을 합리적으로 조정하는데 초점이 맞추어졌다. 현행 헌법 아래에서 대법원장은 주권자인 국민의 직선으로 선출되지 않아 민주적 정당성이 미약함에도 불구하고 과도한 권한이 대법원장에게 집중되어 있기 때문이다. 그래서 제20대 국회에서도 대법원장의 사법행정에 관한 권한을 제한 내지 축소하는 것을 목적으로 다수의 법률안이 발의되었다. 발의된 법률안은 크게 현행 대법관후보추천위원회의 위원구성을 다양화하는 것을 내용으로 하는 법률안과 현행 사법행정체제를 뛰어넘어서 새로운 사법행정기구를 신설하여 대법원장의 사법행정권한을 이 기구로 이관하는 것을 내용으로 하는 법률안으로 구분할 수 있다. 이러한 법률안들은 민주적 정당성에 비례하여 대법원장의 사법행정권을 제한하는 것을 내용으로 하는 것인데 사법권 독립의 원칙과 현행 헌법 규정과 조화를 이루는지는 의문이다. 대법원장의 사법행정권한을 민주적 정당성에 비례하여 합리적으로 조정하는 것도 물론 민주주의 원리에 비추어 요청되는 작업이지만 헌법상의 기본원리인 사법권 독립의 원칙 및 헌법 조항과 조화를 이루어야 헌법적 정당성이 인정된다.

Recent studies showed that tight junctions (TJs) integrity and assembly are required for blastocyst development in mouse and pig models. However, the biological functions of TJs associated with embryo implantation and maintenance of pregnancy were not investigated yet. To examine whether disrupted TJs affect further embryo development, we employed RNAi approach and inhibitor treatment. The embryos were injected with Cxadr (Coxsackievirus and adenovirus receptor) siRNA for knock down (KD) and treated with Adam10 (A Disintegrin and Metalloproteinase specific inhibitor 10; GI254023X; SI). We compared blastocyst development and paracellular sealing assay using FITC dextran uptake between control and KD or SI embryos. Finally, we transferred control and Cxadr KD or Adam 10 SI treated blastocyst to uteri of recipients. Cxadr KD and Adam 10 SI showed lower blastocyst development and more permeable to FITC-dextran. Moreover, we observed that half of KD and inhibited embryos failed to maintain pregnancies after the second trimester. Our findings suggested that TJs integrity is required for the maintenance of pregnancy and can be used as a selective marker for the successful application of assisted reproduction technologies.

In this study, simulation studies were conducted to develop insert injection molds to improve the mass production of terminal assemblies. For the main part of the automobile door latch, charging, holding pressure and deformation analysis were performed according to the gate position of the injection process. As a result of injection molding analysis of the terminal assembly, the flow pattern was uniformly made while maintaining a constant balance of the filling of the product, and the pressure distribution at the time of filling was confirmed. When the analysis results are applied to the mold fabrication in the improved structural method, the transfer lines of the molten resin are controlled by the dam of the 1st injection molding, so that the transmission line is not short-circuited or deformed, and the watertightness, corrosion resistance, and good surface We believe the injection will be possible.

환경풍동 내 공기의 온도와 속도 변화에 대한 공기 유동과 전열 특성을 분석하기 위하여 수치해석을 수행하였다. 풍동 시험부 내 각 단면의 평균 속도, 균일도, 그리고 대류 열전달계수는 노즐 출구의 온도와 속도에 따라 큰 영향을 받게 된다. 노즐 출구로부 터 멀어질수록 평균 속도와 균일도가 점차 감소하고, 노즐 출구의 속도가 50km/h일 때 공기온도가 -40~60oC까지 변화함에 따라 단면 평균 속도와 균일도가 각각 약 12.9%와 13.5% 정도까지 증가하였다. 또한 시험부 바닥의 대류 열전달계수는 50~150km/h의 속도 변화에 대해 약 59.7%까지 증가하였으며, 공기의 온도와 속도가 증가함에 따라 시험부 열 유속도 함께 증가하였다. 본 연구에서 수행한 결과들은 최적의 환경풍동 설계에 필요한 주요 설계 자료로 활용될 수 있을 것으로 기대된다.

우리나라는 그 동안 중앙집권적 통치에 익숙한 나머지, 의회가 제정한 법률만이 권리를 제한할 수 있다고 하는 것은 지방자치가 실시되지 않던 시절의 중앙집권식 사고를 탈피하지 못한 결과로 보인다. 그 논란 중의 하나가 바로 지방자치법 제22조 단서의 문제이다. 지방자치법 제22조 단서가 법률개정으로 삭제되든 그렇지 않든 이로 인해 조례의 제정범위와 관련하여 법률의 유보 없이 권리를 제한할 수 있을 것으로 보이지는 않는다. 그렇다면, 여기서 조례제정권의 한계와 관 련한 논의가 제22조 단서에 관한 논의에 국한되어서는 안 된다는 것을 확인할 수 있다. 조례로 주민의 권리 제한적 사항을 정할 수 있도록 하기 위해서는 지 방자치법 제22조 단서를 삭제하는 소극적인 태도에 그치는 것이 아니라, – 기본권 제한의 법률유보에 상응하는 – 이른바 ‘기본권 제한의 조례유 보’를 지방자치법에 규정하는 적극적인 태도가 요청된다고 할 것이다. 특히, 지방자치단체의 포괄적 자치권, 지방의회의 민주적 정당성, 지방 자치의 보충성, 공공복리 실현을 위한 지방권력 행사 등을 고려하면, 지금과 같은 입법권의 분점에 대한 재고가 요청된다고 할 것이다. 한편, 국가와 지방자치단체 간의 관계가 일방적이거나 억압적이라면 건강한 지방자치가 이루어지고 있다고 평가하기 어렵다. 지방분권형을 지향하는 국가라면, 양자의 관계는 상호교차적이어야 할 것이다. 이를 위해서 제도적 장치는 반드시 필요할 것이다. 지금과 같은 상황에서는 현재 인정되고 있는 제도적 장치만으로는 그 실효성에 의문을 가질 수밖에 없지만, 정치의 영역에서 중요한 것은 정치적 관행이기 때문에 지방의 의사를 국가에 지속적으로 피력하는 것이 중요하다고 할 것이다.

Assembly of automobile interior materials is very important for assembly and inspection such as sensitivity and noise reduction. Particularly, since assembling parts of automobile interior parts is manually assembled by a worker, a claim due to poor assembly sometimes occurs. In addition, as the labor cost rises, automobile assembly line adopts automatic assembly device as the concept of smart factory in assembly process. Therefore, in this study, we intend to develop automatic assembly device of the door trim for reducing the field claim, improving the productivity, and reducing the assembly failure.

As the desires of market get various, so its demand fluctuates frequently. The only companies that flexibly meets fluctuating demands can survive in the fierce market competition. In this study, we deal with the development of jig system for manual welding processes that can cause flexible actions and uniform quality in the manufacturing shock absorber base assembly of automobile. For this we review the processes of design and development through analysis of the technology and the customer that are patents analysis, customer desires analysis, functional analysis and so on. Moreover, we review the relevant indicators for improvement of productivity that are production capacity, cycle time and error rates etc. as the technology is developed.

이른 바‘뉴 테러리즘’으로 지칭되는 새로운 양상의 테러가 세계 곳곳에서 지속적으로 발생하고 있는 상황에서 우리나라 역시 이에 대한 대응책으로 치열한 논란 끝에 2016년 3월 ｢국민보호와 공공안전을 위한 테러 방지법｣(법률 제14071호)을 제정한 바 있다. 그렇지만 이 법을 둘러싼 논란은 입법 이후에도 지속되어, 법의 본격적인 시행을 앞두고 헌법재판소에 일부조항에 대한 위헌청구가 제기된 바 있고, 심지어 법의 폐지를 내용으로 하는 개정안이 발의되어 국회에 계류 중인 상황이다. 그 동안 이와 관련된 학계의 논의는 테러방지의 효과성 내지 효율성을 높이기 위한 개선방안을 중심으로 전개되어 온 측면이 강하지만, 지속적으로 제기 되어 온 테러방지를 위해 운용되는 국가권력으로 인해 일반 국민의 기본 권 영역에 크고 작은 제한이 가해질 수도 있다는 우려 역시 염두에 둘 필요가 크다 할 것이다. 이에 본고는 입헌주의의 핵심원리 가운데 하나라 할 수 있는 실질적 법치 주의의 원리의 측면에서 특히 국회에 계류 중인 테러방지법제 개정안들을 중심으로 테러방지체제의 기본권 보장 강화방안을 모색해 보았다. 결론적으로 현행 테러방지체제의 핵심적인 기본권 보장 기제라 할 수 있는 인권보호관 제도는 구조적인 한계를 가질 수밖에 없다고 판단되므로, 향후 개선방안으로는 단기적으로는 국회의 통제권한을 강화하기 위한 방안을, 장기적으로는 테러방지체제 자체의 구조적 개편을 제안한다.

The setting of values on door hinge mounting compensation for door assembly tolerance is a constant quality issue in vehicle production. Generally, heuristic methods are used in satisfying appropriate door gap and level difference, flushness to improve quality. However, these methods are influenced by the engineer's skills and working environment and result an increasement of development costs. In order to solve these problems, the system which suggests hinge mounting compensation value using CAE (Computer Aided Engineering) analysis is proposed in this study. A structural analysis model was constructed to predict the door gap and level difference, flushness through CAE based on CAD (Computer Aided Design) data. The deformations of 6-degrees of freedom which can occur in real vehicle doors was considered using a stiffness model which utilize an analysis model. The analysis model was verified using 3D scanning of real vehicle door hinge deformation. Then, system model which applying the structural analysis model suggested the final adjustment amount of the hinge mounting to obtain the target door gap and the level difference by inputting the measured value. The proposed system was validated using the simulation and showed a reliability in vehicle hinge mounting compensation process. This study suggests the possibility of using the CAE analysis for setting values of hinge mounting compensation in actual vehicle production.
