        Since the September 11 terrorist attacks in the United States, concerns about intentional aircraft crashes into nationally critical facilities have soared in countries around the world. The United States government advised nuclear utilities to strengthen the security of nuclear power plants against aircraft crashes and stipulated aircraft crash assessment for new nuclear facilities. Interest in military missile attacks on nuclear facilities has grown after Russia attacked Ukraine’s Zaporizhzhia nuclear power plant, where spent nuclear power dry storage facility is operated. Spent nuclear fuel dry storage facilities in nuclear power plant sites should also strengthen security in preparation for such aircraft crashes. Most, but not all, spent nuclear fuel dry storage facilities in Europe, Japan and Canada are operated within buildings, while the United States and Korea operate dry storage facilities outdoors. Since all of Korea’s dry storage systems are concrete structures vulnerable to crash loads and are exposed to the outside, it is more necessary to prepare for aircraft crash terrorist attacks due to the Korea’s military situation. Residents near nuclear power plants are also demanding assessment and protective measures against such aircraft crashes. However, nuclear power plants, including spent nuclear fuel dry storage facilities, are strong structures and have very high security, so they are unlikely to be selected as targets of terrorism, and spent nuclear fuel dry storage systems are so small that aircraft cannot hit them accurately. Collected opinions on the assessment of aircraft crash accidents at spent nuclear fuel dry storage facilities in nuclear power plant sites were reviewed. In addition, the current laws and regulatory requirements related to strengthening the security of new and existing nuclear power plants against intentional aircraft crashes are summarized. Such strengthening of security can not only ensure the safety of on-site spent nuclear fuel dry storage facilities, but also contribute to the continuous operation of nuclear power plants by increasing resident acceptance.

        In order to reduce the burden of proof on the patent holder and punish the infringer in a lawsuit for intentional patent infringement, a treble damages system was introduced through the revision of the Patent Act article 128 in 2019. Although the effect of compensating for the actual damage to the patent holder and preventing patent infringement was expected, approximately two years and six months have elapsed since the enforcement date of the revised law, and only two cases of increased damages were claimed and sentenced to the first trial. In one case, the provisions of the amended law could not be applied according to the provisions of the Addenda to the Patent Act, and in the other case, ‘intentional’ was not recognized. On the other hand, in the United States, claims for enhanced damages due to willful patent infringement are actively being made, and the court’s judgment criteria for malicious or willfullness have been established through several cases. The increase in cases of infringement of malice and enhanced damages before and after the Halo judgment of Supreme court has been confirmed through empirical analysis of related judgments. In Korean patent practice, the reason why Article 128 Paragraph 8 of the patent is not actively utilized is the supplementary provisions that limit the application of the enhanced damages system to infringement acts after July 2019, but it will be resolved naturally with the passage of time. A more fundamental cause is that the criteria for judging ‘intentional’ in ‘infringement recognized as intentional’ in Article 128 (8) of the Patent Act have not been established due to the small number of related cases. In Seoul Central District Court 2020Gahap505891 decision ordered on May 27, 2021, the court recognized that the plaintiff had delivered goods to the defendant and advertised that the plaintiff had the patent right, but it was difficult to admit the defendant’s intention to infringe on the patent. It was judged that the evidence was insufficient. However, it is difficult to conclude that the court’s criteria for judgment of intentionality are strict only with one case in which intention is denied. Considering the purpose of the Patent Act revision and inclusion of willful negligence in interpreting Civil Act §750, a more relaxed standard should be applied to intentional patent infringement. Furthermore, in order to make the proof of intentional infringement more clear as a patent holder, the ‘warning letter’ should be actively used even before litigation. A suspect infringer shall get advice from experts to avoid intentional patent infringement even before he or she receives a warning letter from the patent holder.

        본 논문에서는 우리나라에서 2019년 7월부터 시행된 특허법 상징벌적 손해배상제도 관련 국내외 판례 및 우리나라 입법 연혁 등에 비추어 특허 침해의 고의성 요건과 배상액 산정 시 고려사항을 분석하였다. 먼저, 특허 침해에 대한 징벌적 손해배상제도를 예전부터 도입한 미국의 사례를 분석하였다. 특히 미국은 최근 30년간 판례에 의해 징벌적 손해배상 기준에 큰 변화가 있어왔는데, 징벌적 손해배상의 대상이 되는 악의적, 고의적 특허 침해의 의미에 초점을 맞추어 판례 변화를 분석하였다. 또한, 미국 판례와 모델법에서 언급된 배상액 산정 시 고려사항과 우리나라 특허법에 도입된 고려사항을 비교하였다. 마지막으로, 징벌적 손해 배상 도입과 관련한 우리나라의 입법 연혁을 살펴봄으로써 고의적 특허 침해의 의미 및 배상액 산정 시 고려사항에 대한 입법 의도를 추론하였다. 고의적 특허침해를 위해서는 침해자에게 유효한 특허의 보호범위에 속하는 발명을 실시하고 있다는 인식이 필요하다. 이를 위해 특허권자는 경고장이나 특허심판원의 권리범위확인심판 심결 등을 활용할 수 있을 것이다. 침해자는 특허의 무효성 또는 비침해 판단을 담은 전문가의 의견이나 경고장의 주장을 반박하는 답변서 등을 통해 대응할 수 있어야 할 것이다. 다만, 침해자에게 최소한의 선행기술분석 의무를 지우기 위해서는 중과실에 의한 침해 또한 징벌적 손해배상의 대상에 포함시키는 것이 합리적일 것이라고 고려된다. 또한, 징벌적 손해배상액을 산정할 때 판사에게 여러 가지 요소를 종합적으로 분석하도록 재량을 부여하는 것이 필요하다. 징벌적 손해배상이 무고한 사람에게 미치는 부정적 영향, 소송당사자로서의 침해자의 행동 또는 침해자가 침해 행위를 숨기려 했는지의 여부 등의 고려사항을 추가 하는 것도 생각해볼 수 있을 것이다.

        This study aims to demonstrate the effectiveness of social media marketing as a tool in communicating a “populist” (Scott, 2015) luxury fashion brand’s good intentions toward ordinary people; it also seeks to identify whether luxury fashion brands frequently perceived as exclusive and “envied” could become approachable and “admired” brands, simply by expressing “warm” intentions on their social media sites. Ultimately, we aim to investigate whether positive relational outcomes can be derived from the brand repositioning process, from envy to admiration. This study builds on the brands as intentional agents framework (Kervyn, Fiske, & Malone, 2012), which categorizes brands in terms of their “intentions” and “ability”: “able/ill-intentioned” luxury brands are categorized as “envied brands,” while “able/well-intentioned” brands elicit the general public’s admiration. Our pre-test results confirmed that consumers can sense a brand’s good intentions and ability via its social media site. We then conducted an online selfreported survey among 488 US women aged 18–49 years who were following or “liking” at least one luxury fashion brand’s official social media site. Using structural equation modeling, we found that intentions have a negative impact on consumer envy, and that they have a positive impact on consumer admiration. Ability was found to have a positive impact on consumer admiration of the brands, while it has a negative impact on consumer envy. Although we confirmed negative directions, consumer envy of the brands had nonsignificant impacts on both emotional brand attachment and brand forgiveness. However, consumer admiration of the brands had a positive impact on both kinds of brand responses. In conclusion, while most luxury fashion brands have stuck to exclusivity, the findings of this study imply that by continually showing good intentions towards ordinary people, luxury fashion brands could reposition themselves as admired brands, which would in turn enhance emotional brand attachment. In this way, these brands could cultivate affectionate and passionate consumer–brand relationships making consumers feel more connected to them. In doing so, luxury fashion brands can acquire through social media powerful consumer allies (Phan, Thomas, & Heine, 2011), who are willing to forgive their failures.

        Background: The continuous co-contraction of the trunk muscles through trunk stabilization exercises is important to patients with lumbar spinal stenosis (LSS). However, intentional abdominal muscle contraction (IAMC) for trunk stabilization has been used only for specific training in the treatment room. Objects: The purpose of this study was to provide feedback to adults with LSS to enable IAMC during activities of daily living (ADLs). Methods: The participants with spinal stenosis were divided into an experimental group of 15 adults and a control group of 16 adults. Electromyographic signals were measured while the subjects kept their both hands held up at 90°. The measured muscles were the rectus abdominis (RA), external oblique (EO), internal oblique (IO), and erector spinae (ES). Pelvic tilt was measured using a digital pelvic inclinometer. The degree of pain was measured using the visual analogue scale (VAS) and functional capacity was measured using the Korean version of the Oswestry disability index (KODI). Results: While the experimental group showed statistically significantly higher activities in the RA, EO, and IO after the intervention compared with the control group. Pelvic tilt was significantly decreased only in the experimental group. Both the experimental and control groups exhibited statistically significant declines in the VAS and KODI (p<.01). In terms of the levels of changes, the experimental group exhibited a statistically significant larger decline only in the VAS and the pelvic tilt when compared with the control group (p<.05). Conclusions: The subjects could stabilize their trunks, and relieve their pain and dysfunctions and reduce pelvic tilt by learning abdominal muscle contraction during ADLs.

        본 연구에서는 식육원료 4종(소, 돼지, 말 및 닭)을 각 각 판별하기 위하여 real-time PCR을 이용한 판별법을 개발하였다. 종판별을 위한 유전자로는 미토콘드리아 유전자 중 12S rRNA와 16S rRNA 부분을 대상으로 하였으며, 특이 프로브의 Reporter dye는 FAM, Quencher dye는 TAMRA로 설계하였다. 개발된 프라이머 및 프로브 세트 로 유사종에 대한 비 특이적 signal의 생성 유무를 관찰하기 위하여 총 10종을 대상으로 특이성을 확인한 결과, 비 특이적 signal은 확인되지 않았다. 식육원료에 대하여 realtime PCR을 통한 식육 판별 시 식육 혼합 방법에 따른 CT값의 유의적인 차이는 없었다. 의도적 혼합 및 비의도적 혼입을 판별하기 위한 정량법 개발에서는 의도적 혼합의 경우 100% 식육과의 CT 값 차이가 4 cycle 이내이고, 비의도적 혼입일 경우 100% 식육과의 CT 값 차이가 6 cycle 이상이었다. 따라서 본 연구를 통하여 개발한 식육 원료의 의도적, 비의도적 혼입 판별법은 불량식품 유통 근절 및 소비자 인권보호에 크게 기여할 것으로 기대된다.

        목적 : 본 연구는 뇌성마비 아동에게 의도적인 다감각환경(스노즐렌) 프로그램을 적용하여 아동의 눈-손 협응 능력에 미치는 영향을 알아보고자 하였다. 연구 방법 : 세 명의 뇌성마비 아동을 대상으로 12주간 의도적인 스노즐렌 프로그램을 적용하였다. 중재 프로그램의 효과를 검증하기 위해 사용한 평가도구는 젭슨 손 기능 평가로 7가지 하위검사의 수행시간을 우세손과 비우세손을 구별하여 뇌성마비 아동의 눈-손 협응 능력의 변화를 측정하였다. 결과 : 의도적인 스노즐렌 프로그램 실시 후 3명의 뇌성마비 아동의 젭슨 손 기능 평가 항목의 수행시간이 모두 23.4%이상 감소하였고, 작은 물건집기를 제외한 모든 평가 항목에서 스노즐렌 중재 후에 통계적으로 유의한 차이를 보인 우세손 뿐만 아니라 비우세손도 중재 후에 카드뒤집기, 작은 물건 집기와 먹기 흉내내기, 장기말 쌓기 항목에서 유의한 차이를 보였다(p<.05). 결론 : 본 연구의 결과를 통해 의도적인 다감각환경 프로그램이 뇌성마비 아동의 눈-손 협응 능력 향상에 긍정적인 효과가 있음이 증명되었다. 이와 같은 연구를 토대로 국내에서도 다감각환경(스노즐렌) 프로그램의 효과를 검증 하는 보다 많은 연구가 이어지길 기대한다.
