본 논문은 분점정부 하에서 국회 효율성을 ‘공공선택론(Public Choice)’ 의 관점에서 분석하였다. 기계·경제적, 사회·정치적 등 다양하게 측정되 는 효율성의 개념을 살펴보고, 국회 효율성을 국회 위원회 제도, 대통령 거부권, 국회의원의 활동 및 국회 의안 처리를 기준으로 분석하였다. 구 체적으로 뷰캐넌과 톨록의 집단의사결정에 관한 이론을 근거로 국회의 위원회 중심주의 운영제도가 어떻게 효율성을 제공하는지를 분석하였다. 또한 거대 양당의 대결 구도가 더 심각해지는 분점정부(여소야대) 구조가 국회 효율성에 미치는 영향을 대통령 거부권 제도와 연계하여 분석하였 다. 본 연구는 제21대 국회 상반기는 단점정부로, 하반기는 분점정부 구 조라는 데 주목하면서, 대통령 거부권 행사, 국회의원의 활동, 국회의 의 안 처리 등을 각각 비교·분석하였다. 제21대 국회의 효율성은 단점 정부 인 상반기가 하반기보다 상대적으로 높게 나타났다. 분점정부에서 나타 날 수도 있는 국회 효율성이 상쇄된 것은 여야의 양당 정쟁 구조가 대통 령과 국회의 극단적인 대결 구도로 굳어지고 있다는 것을 시사한다.

In the case of the Pohang earthquake, which had a magnitude of 5.4 in 2017, geotechnical damages such as liquefaction and ground settlement occurred. The need for countermeasures has emerged, and experimental research in the Pohang area has continued. This study collected undisturbed samples from damaged fine-grained soil areas where ground settlement occurred in Pohang. Cyclic tri-axial tests for identifying the dynamic characteristics of soils were performed on the undisturbed samples, and the results were analyzed to determine the cause of ground settlement. As a result of the study, it was determined that in the case of fine-grained soils, ground settlement occurred because the seismic load as an external force was relatively more significant than the shear resistance of the very soft fine-grained soils, rather than due to an increase in excess pore water pressure.

In this study, we analyzed how the revenue water ratio(RWR) is affected by changes in conditions of the water supply area, such as the ratio of aging pipes, maintenance conditions, and revenue water. As a result of analyzing the impact of pipe aging and maintenance conditions on the RWR, it was confirmed that the RWR could be decreased if the pipe replacement project to improve the aging pipe ratio was not carried out and proper maintenance costs were not secured. It was also confirmed that an increase in the revenue water could be operated to facilitate the achievement of the project’s target RWR. In contrast, a decrease in the revenue water due to a population reduction could affect the failure of the target RWR. In addition to analyzing the causes of variation in the RWR, the calculation of estimated project costs was considered by using leakage reduction instead of RWR from recent RWR improvement project cost data. From this analysis, it was reviewed whether the project costs planned to achieve the target RWR of the RWR improvement project in A city were appropriate. In conclusion, the RWR could be affected by variations in the ratio of aging pipes, maintenance conditions, and revenue water, and it was reasonable to consider not only the construction input but also the input related to RWR improvement, such as leakage reduction, when calculating the project cost.

기업의 비재무적 요소인 ESG는 지속 가능한 개발 및 자연과 인류의 지속 가능한 공존을 위해서는 거부할 수 없는 거대한 흐름이 되었다. 그리고 ‘E’ 와 ‘S,’ 그리고 ‘G’ 중에서도 특히 ‘G’는 전자를 실현하는 중심축이자 뿌리 라고 여겨진다. 그런데 기업지배구조를 개선해야할 의무공개매수제도가 기 업의 ESG 가치 제고에 악영향을 끼치는 모순적인 현상이 발생하고 있다. 특히 유럽에서 관찰되는 현상으로는, 주주활동(shareholder engagement) 내지는 주주행동주의(shareholder activism)의 맥락에서 이뤄지는 기관투 자자와 소수주주들의 주권 행사 내지는 경영권 개입이 의무공개매수제도 상 공동행사(acting in concert)로 간주 되어 잔여주식에 대한 매수청약의무를 야기하는 것이다. 의무공개매수제도 재도입 내용을 담은 자본시장과 금융투 자업에 관한 법률 개정안이 현재 제21대 국회에 계류 중인데, 해당 개정안 이 본회의를 통과한다면 우리나라 법제도 기업지배구조의 개선과 ESG 가치 제고라는 두 목표가 상충하는 상황을 마주하게 된다. 인수·합병 시 소수주 주 보호 체계의 미비로 인한 ‘코리아 디스카운트’를 해소하기 위한 개정안이 주주활동 내지는 주주행동주의의 걸림돌 내지는 그 방어기재로 작용하여 다 른 차원의 ‘코리아 ESG 디스카운트’를 야기할 위험이 있는 것이다. 의무공개매수제도가 주주의 경영개입을 억제하는 모순은 본질적으로는 공 동행위 또는 공동보유의 기준과 해석을 통해 해결할 문제이다. 하지만 개인 적으로는 이 모순을 해결하기 위한 시작점은 의무공개매수제도의 적용기준 인 지배권 기준에 대한 접근방식을 재검토하는 일이라 본다. 우선, 지배권 기준은 시대와 국가, 시장, 회사, 사안, 상황마다 다르기에 획일적인 지배권 기준은 최선의 규제방식이라 보기 어렵고, 둘째, 그러므로 지배권에 대한 개 념을 각 회사가 처한 환경과 상황에 맞게 설정한다면 인수·합병 시 불합리 하게 낮은 가격으로 주식을 매각해야 하는 압박으로부터 잔여 소수주주를 효과적으로 보호하면서도 의무공개매수제도로부터 일정 수준 자유롭게 주주 활동 내지는 주주행동주의 차원의 주주 간 연대를 장려할 수 있으며, 셋째, 각 회사에 적합한 지배권 기준의 설정을 통하여 공동행사에 대한 기준 설정 과 해석을 통한 예외를 허용하는 번잡한 문제를 사전에 해결할 수 있기 때 문이다. 이와 같은 법제는 ESG 가치 제고를 선호하는 지배주주가 단기이익 의 증진을 요구하는 다른 주주들의 반대를 이겨내기 위해 기관투자자 등과 연대하는 경우 의무공개매수제도가 걸림돌이 되는 문제도 예방한다는 차원 에서 큰 의미가 있다. 그러므로 이 글에서는 국내외 의무공개매수제도 상 지배권 기준을 비교· 분석함과 더불어 우리나라 상사법상 지배권의 개념이 상대적이라는 근거를 제시함으로써 추상적인 개념이자 상대적인 기준인 지배권에 대한 접근방식 재검토 필요성을 도출하고, 이 논의를 바탕으로 지배권 기준에 대한 회사의 재량권을 인정하는 입법론을 제시하기로 한다. 이 모든 논의의 지향점은 우 리나라 기업들이 ESG 가치를 제고하는 데 적합한 환경을 조성하는 것이다.

It is very important to evaluate how the functions of products, facilities, and spaces affect human life. The evaluation of these actions has legal regulations such as certification, inspection, and diagnosis, and the degree of quality, safety, and excellence of the results is announced. This study sought to secure safety through efficient system operation by reviewing safety-related certification systems established and implemented by each government department in Korea and analyzing the characteristics of each system and similarities between systems. There was also an aspect of cross-checking safety through the certification and diagnosis system implemented by each ministry, but it was confirmed that the efficiency of the system should also be considered in terms of overlapping application. Therefore, when securing safety is confirmed based on each safety-related law, active alternatives such as exemption, substitution, delegation, etc. should be presented.

본 연구는 한국어가 인도네시아어로 번역되었을 때 나타난 결속구조 전환을 연구하는데 목적이 있다. 번역과 결속구조는 서로 긴밀하게 연 결되어 있다. 번역 과정에서 결속구조를 적절하게 해석하고 전달하는 것은 번역의 일관성과 의미 전달에 영향을 미치기 때문이다. 결속 구조 를 분석하기 위해 원문과 번역문에서 100문장을 추출한 후 보그랑데와 드레슬러(Beaugrande & Dresseler, 2008)의 결속구조 모델을 사용하 여 한국어와 인도네시아어의 결속구조를 분석했다. 분석 결과 한국어와 인도네시아어 번역문에서 대용형, 접속 표현, 회기법 및 부분 회기법, 환언, 생략법의 순서로 결속구조가 전환되었음을 확인하였다. 이 연구 내용이 번역 교육의 예시로 활용하거나 번역자들의 실무에 도움이 되 기를 기대해 본다.

This study aims to explore the appropriate water pressure control of water supply pipeline to reduce water losses of water supply network in Jinan-gun. The current water pressure status of each 5 blocks and the impact of optimized water pressure on improving revenue water rate were investigated. In order to obtain the flow rate and water pressure data of each small block, a smart hub is set in the pressure reducing valve chamber at the inlet of the small block, and a smart water pressure meter is installed in the fire hydrant and the faucet of the customer. For the pressure reducing valves installed for water pressure management system of each block, the diameter calculation standard and type of the pressure reducing valve are determined, and the application reasons are put forward. The analysis results of water pressure management for each small block in Jinan-gun show that the pressure control equipment and water pressure management need to be improved in four small blocks. The water flow rate in Jinan-eup and Sangjeon-myeon increases from 57.2% to 87.6% when the water pressure control is completed.

This study set up the revenue water ratio that could be achieved within the range of the expenses of the water distribution network maintenance project, developed an analysis methodology that could estimate the additional project quantity to achieve the target revenue water ratio of 85% and applied and verified that to S. City. This methodology allowed the distribution of the leakage quantity for each leakage component by the pipeline through the total revenue water account balance analysis and BABE approach and the redistribution into the calculated leakage quantity more accurately through a step test. In addition, the level of reduction in leakage and the quantity of the project were estimated before and after the application of four strategies for the promotion of the revenue water ratio presented by IWA, according to the leakage components by the pipeline. As a result of the application of this analysis method to S. City, it would be possible to achieve up to the revenue water ratio of 81.0%, which was 74.7% in the beginning, if the water distribution network maintenance project was promoted within the range of the project expenses, and to achieve the revenue water ratio of 85.0%, the goal of the project, it would be necessary to replace the pipeline of 22.2% of the entire pipelines in the target area. As a result of the re-estimation of the revenue water ratio achievable, applying the actual water distribution network maintenance quantity in the scope of the business with the results of this analysis, the revenue water ratio was 81.7% while the actually measured revenue water ratio was 82.3%. Thus, the reliability of this analysis method could be secured to some extent.

Climate change due to global warming causes a rise in atmospheric air temperature to rise and extreme shift in precipitation patterns. Carbon dioxide (CO2) is widely known as one of the major cause of global warming and accounts for about 72% of total greenhouse gas emissions. Agriculture is more vulnerable to climate change than other industries. Many studies have been conducted to investigate how agroecosystems, both natural and controlled, will respond to the rising level of CO2. Studies on the responses of crops and agricultural environments to climate change are crucial in predicting changes in agro-ecosystems. Research facilities for various types of CO2 treatment have been developed. The representative research facilities are SAR (Soil-Plant-Atmosphere-Research), OTC (Open Top Chamber), FACE (Free Air CO2 Enrichment System), and TGC & CTGC (Temperature Gradient Chamber & CO2-Temperature Gradient Chamber). Therefore, this study reviewed research data and their application in agriculture.

이 글은 구성주의 이론가들의 국제규범(norm) 연구에 대한 비판적 문 헌연구를 바탕으로 신기술과 인권 담론에 발현된 규범 클러스터(norm cluster) 양상을 분석한다. 본 연구의 핵심 질의는 한국 정부가 유엔인권 이사회 차원에서 제기되고 있는 ‘신기술과 인권’ 의제를 주도하면서도 이 와 개념적으로 연계되어 있는 자율살상무기금지 규범에는 소극적인 ‘선 택성’의 원인이 무엇인가 하는 것이다. 본 연구는 특정 국제규범이 메타 규범·구성규범·실행규범의 다층적 성격을 가진다는 규범 클러스터 연구의 적용을 통해 신기술과 인권 의제가 메타규범에 자율상살무기 금지규범이 실행규범에 해당하며, 이러한 선택적 규범화 전략이 사실 자연스러운 것 일 수 있음을 주장한다. 또한, 신기술과 인권 관련 국내·외 담론에서 확 인되는 ‘파편성’ 역시 우리 정부의 전략에 영향을 미친바, 이는 본 연구 가 국내 핵심이해관계 당사자를 대상으로 수행한 인터뷰에서도 확인된 다. 이에 더해, 메타규범 차원에서는 한국의 역할제고에 기여하며 뚜렷한 정책비용을 수반하지 않는 신기술과 인권 담론이 실행규범 차원에서는 안보정책 기조와의 충돌이라는 가시적 비용을 수반한다는 점 역시 고려 되었다고 볼 수 있다.

부선의 50퍼센트 이상은 선박검사를 ‘무인부선’으로 받고 있다. 무인부선의 두드러진 이점은 유인부선에 비해 약 25퍼센트의 건현에 해당되는 화물을 더 적재할 수 있다는 것이다. 한편, 무인부선에도 항해 중에 선석 접안과 이안, 투묘와 양묘, 항해등화의 점등과 소등 등과 같은 업무를 담당할 선원이 필요하다. 피상적인 인식은 예인선이 부선 운항에 대한 책임을 진다는 것이지만, 부선 운항자가 예 선을 용선하는 경우처럼 다른 사례들도 다수 있다. 특정 계약관계에서는 예선이 부선의 운송인에 불과할지라도 예선 선장은 그 운송계약 (항해)을 완성하여야 하는 의무를 이행하여야 한다. 상당수의 예선 선장은 부선 제원과 선두 정보를 제공받지 못하고 있으며, 이러한 형태 는 선장의 권한을 존중하지 않는 것이며 관련 법령을 의도하지 않게 위반하게 된다. 이 연구는 이러한 문제점을 해결하기 위하여 정책적 접근을 통해 무인부선을 유인부선화하고, 승무정원증서를 발급받도록 하며, 부선과 선두의 정보를 예선 선장에게 제공하는 등 세 가지 개 선방안을 제시하고자 한다. 이러한 제안을 통하여 선두의 권리를 개선하고, 법령(최대승선인원) 위반 부담을 해소하며, 예선 선장의 권한 을 보장할 수 있을 것으로 기대된다.

As cable TV, which has been leading the paid broadcasting market, has given the lead to IPTV, which has huge communication capital, its competitiveness is gradually weakening. This study examines the operation status of local cable TV and seeks ways to strengthen competitiveness for survival. To this end, we conducted data analysis such as related statistics, broadcasting industry survey reports, IPTV growth reports, CMB management indicators, paid broadcasting literature data, marketing reports, industry success stories, and marketing mix and SWOT analysis. As a result, four strategies for strengthening the survival competitiveness of local cable TV, namely joint purchase apartment marketing strategy, influencer marketing strategy, relationship marketing strategy, and digital marketing strategy were derived. Therefore, the results of this study can contribute to the improvement of the competitiveness of local cable TV, which has been with local residents through close content, and can be used as basic data for establishing marketing strategies for local cable TV in the future.

The rate of industrial accident reduction is slowing down as the attention of the Ministry of Employment and Labor and related agencies on risk assessment systems decreased. this paper focuses on weakness of legal system for the risk assessment in recent years. A survey was conducted to identify the status and condition of the risk assessment system applying on small and medium-sized manufacturing companies. A set of questionnaires is designed to reflect various perspectives of the companies regarding the problems and solutions of the system. The results refer that differentiated instructions and support systems in response to the actual conditions of the companies are mandatory to reinforce the efficiency of risk assessment system.

코로나19는 우리나라 고등교육이 지향하던 미래교육에로의 변화를 앞당겨 경험하게 만들었다. 이론 교 과목 수업은 대부분 온라인으로 운영되었고 실험·실습·실기 교과목은 수강인원을 최소화하여 대면수업을 실시했으며 이론과 실습이 혼재된 교과목 수업은 두 가지 방법을 병행하는 방식으로 진행되었다. 대변혁 의 과정에서 대학교육 정책 수립 및 교육과정 운영자들의 관심이 혼합수업 만족도 제고 방안 모색에 집중 되고 있다. 수도권 S대학에서 교육 정책 및 운영 등 대학교육의 수업 질 관리 차원에서 교육혁신을 주도했던 관련 자들의 포괄적 업무수행이 연구의 기반이 되었다. 코로나19 이후 확대된 대학 자율권을 바탕으로 새로운 정책의 입안과 실행 그리고 평가 과정을 통해서 유의미한 성과가 확인되었고, 그 성과는 통계적으로 검증 되었다. 수도권 S대학에서는 학생 디지털학습역량과 학생-교수 간 상호작용이 수업만족도와 관련이 있다 는 것을 확인한 후 이러한 변수를 통제한 상태에서 수업만족도에 영향을 주는 새로운 변인을 탐색하였다. 본 연구는 수도권 S대학의 각 교과목 유형별로 학생들의 디지털 학습역량과 학생-교수 간 상호작용을 통제한 상황에서 대학의 두 가지 운영방안이 혼합수업 만족도에 영향을 미치는가를 검증하였다. 첫 번째 방안은 각 학생이 수강하지 않는 교과목에 관한 강의동영상을 활용하여 스스로 학습할 수 있도록 하는 것이었고, 두 번째 방안은 기 실시된 대면수업을 정리·요약한 수업요약 동영상을 제작하여 수강생들에게 제공하는 것이었다. 연구결과 이론, 이론+실습, 실험·실습·실기 등 모든 범주의 교과목 유형에서 두 방안 은 수업만족도에 대하여 유의미한 관련성이 있음이 확인되었다. 다만 세 가지 수업형태별 범주에 따라서 새로운 수업 운영방안의 수업만족도에 대한 상대적 중요도가 일치하진 않았다. 고등교육에서 혼합교육 시대의 수업만족도를 제고할 수 있는 또 다른 변인을 찾는 후속 연구가 지속되 어야 한다.

본 연구의 목적은 미국의 확장억제 실행력과 신뢰성 제고를 위한 미국의 저위력 핵무기 개발 및 함의를 규명하는 것이다. 사실상의 핵보유국으로 부상한 북한의 핵위협에 대한 실질적인 대책마련이 시급하다. 이에 북한의 핵능력이 지속적으로 고도화되는 상황에서 한국의 북핵 대응전략은 북핵 위협 억제‧대응을 위한 ‘핵‧WMD 대응체계’ 구축을 위한 핵심전력을 조기에 확보하기 위해 노력하고 있다. 하지만 재래식 전력으로 북핵을 대응하는 것에도 한계가 있고, 핵금기에 따른 확장억제의 신뢰성도 의심받고 있는 실정이다. 이러한 미국의 확장억제 실행력과 신뢰성 제고 측면에서 미국이 개발하고 있는 저위력 핵무기 개발과 함의를 규명하고, 한국의 억제‧대응능력 강화를 위한 방안을 적극적으로 모색할 필요가 있다. 이를 위해 한‧미는 맞춤형 억제전략 발전과 미국의 확장억제 공약의 실행력을 제고해야 한다. 한‧미 연합 억제‧대응 능력을 강화하기 위해 나토의 핵공유와 같이 핵동맹으로 격상시키고, 확장억제전략협의체(EDSCG)보다 긴밀한 고위급 핵계획그룹(NPG) 발전 등이 있어야 할 것이다.
