지상파 재송신은 방송 초창기부터 현재까지 난시청 해소 및 방송 보급을 목적으로 이루어졌다. 그 동안 지상파 방송사업자는 의무재송신 범위를 초과하는 종합유선방송사업자의 지상파 재송신에 대하여 별다른 이의를 제기하지 않았으나, 최근 다양한 방송 플랫폼 제공자가 등장하고 아날로그 방송종료 시점이 임박하는 등 방송 환경이 급변함에 따라 종래의 태도를 바꾸어 종합유선방송사업자를 상대로 재송신 이용료의 지급을 요구하고 나섰다. 지상파방송사업자와 종합유선방송사업자 사이의 법정 공방은 현재 본안 상고심 판결을 앞두고 있지만, 분쟁을 종국적으로 해결하기 위해서는 양측의 이해관계를 조화시킬 수 있는 새로운 지상파 재송신 제도를 마련할 필요가 있다. 구체적으로 지상파방송사업자의 저작권 내지 저작인접권을 존중하되, 국민에게 양질의 방송을 제공해야 할 지상파 방송사업자의 역할을 종합유선방송사업자가 일부 분담해온 사정도 함께 고려된 모델을 연구해야 한다. 이와 관련하여 법정이용허락제도의 도입은 행정입법의 탄력성에 기초하여 급변하는 방송 환경에 대응하여 양측의 이해관계를 유연하게 조율할 수 있다는 점에서 하나의 대안이 될 수 있다.

With the purpose of relieving fringe area and delivering broadcast to the public, the terrestrialbroadcast retransmission by cable broadcasters has lasted from the early days of broadcast untiltoday. Unlikely before, however, terrestrial broadcasters facing environmental change of broadcasthas come into oppose to the practice and ask cable broadcasters for retransmission fee.The legal dispute between terrestrial broadcasters and cable broadcasters would be concludedsoon but new terrestrial broadcast retransmission system drawing harmonious interests isrequired. Concretely, copyright of terrestrial broadcaster should be respected as much as possibleand it is taken account of that cable broadcasters has contributed to delivering broadcast to thepublic. Compulsory license can work out a practical alternative, since it is so flexible based on thenature of administrative legislation that handle the rapidly changing broadcast situation andharmonize the interests of both sides.
