인터넷의 개방성과 유동성 및 네트워크 효과로 인한 발전으로 인해 스마트폰과 앱스토어가 등장하게 되었다. 이러한 현상은 이른바 디지털 컨버전스가 원인이 된 것이다. 디지털 컨버전스는 정보통신 기술이 점차로 여타 산업에 확산되어 기존 산업구조를 재편 및 고도화하고 기존에 존재하지 않던 새로운 산업구조를 형성하는 과정에서 나타나는 제반 현상을 말하는 것이다. 이러한 현상은 음성∙데이터∙영상 등 정보 융합, 방송∙통신∙인터넷과 네트워크의 융합, 컴퓨터∙통신∙정보가전과 같은 기기의 융합 형태로 나타난다. 새로운 커뮤니케이션 수단들이 등장하면서 대중이 미디어의 객체에서 주체로 등장하게 되었고, 특히 디지털 혁명에 따른 각종 새로운 미디어와 통신 수단 등에 익숙한 세대가 생산과 소비의 중심으로 대두되었다. 이에는 이른바, 디지털에 익숙한 세대인 디지털 네이티브, 그리고 생산자와 소비자가 합쳐진 새로운 형태의 소비자인 프로슈머가 주체가 되어 다수의 의견, 경험, 관점 등의 집단지능을 통해 송출하는 매체인 소셜 미디어를 통해 공개적이고 효율적인 방법으로 콘텐츠를 작성하는 Peer-production 을 하게 되는 현상이 그 핵심이며 이러한 현상이 플랫폼에 있어서 네트워크 효과를 통해 확대 재생산되고 있다. 이러한 디지털 컨버전스에 대해 국내 정부에서는 법제도적 기반을 마련하고, 기술 및 인력양성을 하는 등 방송통신 융합 활성화 기반을 조성하는 등 대책을 수립하고 있다. 한편 모든 인터넷 콘텐츠가 네트워크 사업자에게 동등하게 취급받아야 하며, 어떠한 차별도 없어야 한다는 개념의 넷중립성 정책에 대해 찬반 논의가 있는바, 인터넷 자체의 속성상 공공적 측면이 있어야 하고, 콘텐츠의 개발을 위해 이러한 차별은 철폐되어야 하는 등의 이유로 넷 중립성 정책은 지지되어야 한다. 앱스토어에 있어서 저작권 문제가 있는 바, 이에는 애플리케이션 제작자에 의한 침해, 소비자에 의한 이른바 탈옥으로 인한 침해, 앱스토어 관리자의 저작권 침해 방조 책임, P2P에 있어서의 저작권침해 문제가 있다. 이러한 저작권 침해에 대해서는 제작자와 사용자에 대한 저작권 침해에 대한 교육 및 홍보가 필요하며, 앱스토어 관리자 및 P2P업체에서는 전문가의 고용을 통해 방조책임이 일어나지 않도록 철저한 대비가 필요하며, 이를 방지하기 위한 기술 개발과 인력 양성 등의 대책이 지원되어야 한다.

Due to the openness, fluctuation of internet and network effect, now we see the smartphoneand Appstore are introduced. This phenomenon is caused by the “Digital Convergence”. Digital Convergence refers to the phenomenon that the information technology diffuse to theother industries, and it restructre and enhance the industrial structures which had never existedbefore. This appears as the conglomeration of information like sounds, data, video, and that ofbroadcasting, telecommunication, internet and network, and that of the machines like computer,telecom and hitech home appliance.As these ways of communication appears, the people became the main stream, especially thegeneration get accustomed to the new media and communications became the core role ofproduction and consumption.Digital native and prosumer make peer-production through the social media which gathers themajority’s opinion, experience, viewpoint as the collective intelligence openly and effectively. Andthese facts result in expansive reproduction by the network effects.Nowadays, our government make policy like legislative supports, research techonologies, andtrain people. By the way, the net neutrality policy is at issue nowadays. Net neutrality means a principalproposed for user access networks participating in the internet that advocates no restrictions byInternet Service Providers or government on content, sites, or platforms. I agree this net neutralitypolicy, because the nature of internet is kind of public property, and the development of contentswill be encouraged when there are no restriction on it.There are 4 copyright issues on AppStore. The infringement of copyright by the applicationprogrammer, the jailbreak by the consumer, the abiding and abetting the infringement of copyrightby the AppStore Manager, and the infringement of copyright on the P2P sites. It needs to be educate and enlight people on these kinds of infringements of copyright. TheAppStore manager and P2P sites needs to hire the expertise not to violate the copyright. Andgovernment should support the research and development, and the training program.
