우리나라는 지속적인 경제성장과 1980년대 후반부터 시작된 민주화에 힘입어 국민들의 사회복지욕구는 점증되고 있고 사회복지서비스의 내용도 다양화 되어가고 있다. 본 연구는 현장에서 가장 많이 소통되는 일선 공무원과의 업무에 따른 면담을 통하여 사회복지서비스관련 법제에 관한 조례규정에 관심을 갖고 문제해결방법을 시도하였다. 본 면담으로 알 수 있듯이 전달체계에 있어서 재정이 열악한 도시는 정부사업과 도사업에 밀려 시 자체사업을 할 수 없고 공무원은 국가지원에만 의존하는 열악한 환경에서 행정조정자로서의 역할을 하고 있다. 본연구의 목적인 사회복지의 전문성을 위한 사회복지법제의 제도적 발전을 위해서는 우선적으로 제도적인 우선성장을 필수조건으로 하며 시 특성에 맞는 사업은 물론 필요에 따라 조례규정에 대한 복지서비스의 자율권 확대와 통합프로그램으로 전문 프로그램을 신장시켜야 한다. 사회환경 변화에 따라 사회복지서비스도 변화되고 있어 새로운 사회복지욕구에 효과적으로 대응할 수 있도록 서비스관련 법제도 시의 특성에 맞게 재편성되어야 할 것이다. 종전의 중앙집권적 사회복지서비스관련 법제는 지방분권 시대에 맞도록 체질변화가 불가피하다고 평가되어진다.

Amidst the ever-continuing economic growth along with democratization encouraged since late 1980s, the incremental needs for social welfare by and for the people have been put into practice with diversified contents in its services. In light of rapidly changing social environment, nevertheless, there requires the newly reorganized disciplines targeted for social welfare services to effectively cope with multi-facial social demands especially in terms of the statutory aspect. In this regard, the present paper aims for providing several suggestions as follows in a sense that the conventional social welfare service-related legislation featured by government-centered policy making must be refitted to the present era of decentralization.Firstly, clarification of welfare function between the central government and local political bodies,Secondly, enlargement of welfare-related budget in the local governments,Thirdly, improvement of autonomous ordinance enactment by local bodies themselves in connection with social welfare services,Fourthly, strengthening of professionalized welfare services,Fifthly, stronger budgetary support to subjects who are situated at the dead zone apart from welfare benefits, taking into account the local peculiarities and degree of financial autonomy,Sixthly, leadership of principals or chairmen responsible for various social welfare-related governmental or government-subsidized institutions and centers for enhancing the personnel management effectively in the administrative profession of social welfare, andSeventhly, development of community-oriented welfare programs; more specifically, focused on expansion of social welfare services in line with the aging society, development of welfare programs custom-made for regional situation, activation of participation and activities by civilian welfare-related organizations and enhancement of expertise in decentralized welfare service operation.
