대동유아제도란 교정시설에서 여자수용자가 자녀인 유아의 양육을 신청하면 생후 18개월 내까지만 양육을 인정하는 처우로 해방이후 시행하고 있다. 우리나라의 형집 행법은 대동유아를 돌봄의 개인화에만 그치는 고전적인 “양육”(parenting)의 이념으 로 접근하여 영유아보육법에 모든 유아에 대해서 국가의 의무로 명시된 돌봄과 교육 과 복지의 결합적 개념인 “보육”(care and education)의 이념과 돌봄의 사회화로 접근하지 못해 아동의 올바른 발달과 인권 및 양육자의 재생산권을 침해하는 한계를 보이고 있다. 또한 철저한 보안이념과 가부장적 이념에 기인한 대동유아제도로 인하여 유아와 수용자의 헌법상 가족권의 실질적 보장은 형해화되었고 지속적인 애착박탈 과 모성과 부성에 대한 너무나 잔인한 국가 폭력이 되고 있음에도 사회와 국가는 그러한 폭력사실조차 모르고 좋은 제도로만 관념하고 있다.
대동유아제도에 관한 선행연구들도 유아학 등의 학제적 관점에서는 논문은 거의 없으며 보육이 아닌 양육의 이념에서 전부 접근하고 대동유아제에 관한 외국과의 비교 등을 통한 비교법적 연구는 전무하다.
따라서 본 논문에서는 애착이론과 대동유아개념론 및 대동유아에 관한 외국의 제도들을 살펴보고 나서 아동과 양육수용자의 헌법과 관련 법의 정당한 인권을 담보하 는 “교정보육”이란 새로운 대동유아처우이론을 포함한 독창적인 개선방안을 제시하였다.

Korean correctional authorities has implemented a correctional policy to allow female inmates to bring up their infants up to 18 month after birth if they apply infant parenting to prison governor.
The law on the execution of sentences on the parenting infants in prison is only the personalization of the care so-called classical parenting that prevents access to the socialization of the care and infant care with education provided under the child care act which includes care and education.
As a result, the healthy development and human rights of infants and female inmates and the guarantee of their family rights under the constitution has been violated and continued attachment deprivation against the mother(father) inmates have continued due to the drastic prison guard idealogy and patriarchal system.
But the existing studies on the correctional policy on the infant parenting by inmates almost have approached from parenting idealogy, not from care including education and there was little comparative studies of it.
Therefore, I showed my original improvement idea implying new theroy of infant care which guarantees their rightful rights after looking at infant development theroy and foreign institutions of prison infant care.
