제주도는 섬이라는 지리적 특성 때문에 해운항만산업이 매우 중요하다. 그러인프라 시설, 항만배후단지와 같은 항만 부대 산업, 해운산업과 관련된 법과 정책에 대한 개선이 필요하다.
특히 2014년 세월호 사고 이후 비표준 철재상자, 화물자동차 등의 적재와 고박을 포함하는 화물고박기준에 대한 수용가능성과 적용 여부 등과 관련하여 선박안전법제와 화물취급실무 간의 괴리로 다양한 문제가 대두되었다. 그 이유는 선박운항자 등이 화물적재와 고박의 안전 확보에 대한 행위에 대하여 정부가 신뢰하지 못함에 기인한다.
따라서 이 연구는 선박운항의 현실에 적합하면서도 미래지향적인 다양한 적재와 고박 방법을 반영한 화물적재고박기준에 관한 개정안을 제시하였다. 또한 선사 및 화주들이 화물 적재와 고박의 안전에 대한 일차적인 책임자임을 자각함으로써 화물적재와 고박 안전에 관한 기준을 철저히 준수하여야 한다는 점을 지적하였다.
Given the geographical characteristics of Jeju Island, the maritime and port sector is regarded as very important. Therefore, it is necessary to improve the relevant laws and policies related to maritime industry and port logistics industry such as cargo handling facilities, logistics infrastructure and port hinterland, etc. in order to secure the smooth handling of inbound and outbound cargoes in Jeju Island.
In particular, various issues have been raised due to a big gap between the existing legal system of the Ship Safety laws and regulations and cargo stowage and securing practices in respect of practical acceptability and applicability of cargo securing standards including securing non-standard steel boxes and cars and trucks on board since the M/V Sewol disaster in 2014. The reason is attributable to the fact that the government does not trust the ship operators behavior for the safety of cargo stowage and securing.
Thus, this study proposed an amendment to the cargo stowage and securing standards reflecting various cargo stowage and securing methods adaptable to current ship operating practices as well as future-oriented and it is pointed out that shipowners and shippers should be fully compliant with the safety standards of cargo stowage and securing through recognizing their primary responsibility relating thereto.
