우리나라 산업계의 악행으로 지적되었던 직장 내 괴롭힘이 사회적으로 큰 이슈화 되면서 근로기준법과 산업안전보건법을 2019년 개정하여 직장 내 괴롭힘 예방 및 처벌 등에 관한 규정이 시행되고 있다. 선원법에는 이와 관련한 명시적인 규정이 부재하여 선박에서 괴롭힘 예방을 위한 조치를 시행함에 있어서 법적 공백이 발생할 여지가 있다. ILO에서는 지난 2016년 해사노동협약을 개정하여 선원의 괴롭힘 및 따돌림을 방지하기 위한 안전보건의 책임을 당사국과 선박소유자에게 부여하고 있다. 또한 ILO 제108차 총회에서는 모든 사업장에 적용되는 직장 내 폭력 및 괴롭힘 제거를 위한 국제협약을 채택하기도 했다. 이처럼 국제적으로도 직장 내에서 발생하는 괴롭힘을 예방하기 위한 기준이 강화되고 있는 추세이다.
이 논문은 선박에서 선원을 대상으로 발생하는 괴롭힘을 예방하고 조치하기 위한 개선 방안을 도출하기 위해서 직장 내 괴롭힘을 규제하는 국내법과 ILO 의 국제노동기준을 검토하였다. 그리고 선내 괴롭힘을 예방하고 조치하기 위한 선원법 개선 방안을 제시하였다.

Harassment which was pointed out as an evil behavior in the South Korea industry has become a critical social issue, consequently the Labour Standards Act and the Industrial Safety and Health Act were revised in 2019 to enforce regulations on the prevention and measurement against harassment in the world of work. Since there is no explicit regulation related to it in the Seafarers’ Act, there may be a legal vacancy in the implementation of measures for preventing harassment in ships by shipowners like the Labor Standards Act. The ILO amended the Maritime Labour Convention in 2016 to give the State party and shipowner the responsibility for safety and health to prevent harassment and bullying against seafarers. In addition, the Convention concerning the Elimination of Violence and Harassment in the World of Work, which applies to all workplaces was adopted at the 108th’ General Labour Assembly. As such, internationally, the standards for preventing harassment in the workplace are being strengthened.
This paper reviews the domestic laws of South Korea regulating harassment at workplace and the International Labour Standards of the ILO in order to derive improvement measures to prevent and take measures against harassment in ships. Through it, the draft Amendments of the Seafarers’ Act and plans to prevent and countermeasure harassment in ships are suggested.
