A Comparative Study of Local Government Ordinances Supporting Slow Learners
이 연구는 느린학습자 지원정책의 제도적 기반을 점검하기 위해 전국 35개 기초지방자치단체의 느린학습자 지원 조례를 비교·분석하고, 조례 개선 방향을 제시하는 데 목적이 있다. 연구방법으로는 자치법규정보시 스템에서 수집한 조례 원문을 대상으로 내용분석을 실시하였으며, 규범 적 타당성과 규범적 실효성의 분석틀에 따라 조항의 내용과 규정 수준을 비교하였다. 분석 결과, 첫째, 대부분의 조례는 느린학습자의 자립과 사 회참여를 지향하고 자치단체장의 책무를 명시하였으나 적용대상 정의에 는 지역 간 차이가 있어 동일한 특성의 대상자가 거주 지역에 따라 지원 에서 배제될 가능성이 확인되었다. 둘째, 지원 영역은 교육·복지·진로·자 립을 포괄하는 경향을 보였으나 예산 지원은 모두 임의규정으로 되어 실 질적 재정 확보가 불안정하였다. 셋째, 전달체계의 핵심 요소는 임의규정 이거나 부재하였고, 35개 조례 모두 전문인력 규정이 없어 집행의 실효 성이 낮았다. 이에 적용대상 표준화, 예산 지원의 강행규정화, 전달체계 보완, 전문인력 기준 마련을 통해 느린학습자의 교육권과 복지권을 실질 적으로 보장할 필요가 있다.
This study examines the institutional foundation of policies supporting slow learners by comparatively analyzing ordinances enacted by 35 basic local governments in Korea and proposes directions for their improvement. Using ordinance texts collected from the Local Government Law Information System, a content analysis was conducted based on the analytical framework of normative validity and normative effectiveness. The results show that most ordinances emphasize the independence and social participation of slow learners and specify the responsibilities of local government heads. However, differences in the definition of target populations across regions may lead to unequal access to support. Although support areas generally include education, welfare, career development, and independent living, budget provisions are discretionary and delivery systems remain weak. In addition, none of the ordinances include provisions for professional personnel. These findings suggest the need to standardize target definitions, strengthen delivery systems, and secure mandatory budget provisions to effectively guarantee the rights of slow learners.
