The United Nations Convention on the Law of the Sea (UNCLOS) has been ratified by 168 countries. Among these countries, Indonesia is one of the most notable states concerning compliance with the provisions of the UNCLOS. However, the aggressive actions exhibited by countries seeking to become world hegemonies have resulted in the violation of the Convention. Therefore, this research aims to critically analyse the problems associated with any violations of sovereignty and sovereign rights by foreign research vessels which are conducting commercial and military navigation in Indonesian waters (territorial sea with the archipelagic waters and the inland waters). This research shows that the spirit of the Djuanda Declaration constituting the main principle of the Indonesian Republic is a legal ground for defending the national interest of Indonesia as an archipelagic state. This is the key to maintaining the integrity of sovereignty and national interest.

Today’s technological developments have resulted in the emergence of various new crimes threatening the international community. In recent decades, there have been various forms of cybercrimes targeted at the communication networks and defense systems of countries by other countries, known as cyber warfare. Unfortunately, international law has not specified this as a crime, but its impact has caused violations of sovereignty and disruption of national security, resulting in material loss, breakdown of communication networks and obstruction of social and public services based on the internet, such as what happened in Estonia in 2007. This article is a normative study that analyzes the elements of cybercrime relating to threats to a country’s security. The modification of the cybercrime concept is necessary to designate cybercrimes as crimes of aggression amid technological development to maintain stability in the international community.

Global warming, or climate change, could be the main reason why small islands in many areas of the Earth, including those in Indonesian territory, are sinking. Many small Indonesian islands are between 1 and 3 metres under the surface of the sea because of raised sea levels caused by climate change. If this situation continues, it would affect many of the outermost islands of Indonesia, so that we should anticipate the danger that the outermost islands would be submerged. The basepoints and archipelagic baselines would then be replaced, among other serious consequences for Indonesia. The Paris Climate Agreement, signed by almost 200 states in 2015, is the main instrument for mitigating global warming through reducing the emission of greenhouse gases. Indonesia ratified the Paris Climate Agreement, because it has a great interest in mitigating the phenomenon that is causing the sea level to rise, which is having a serious impact on its islands.

The PCA’s decision refusing historic rights concerning the 9-DL cannot be enforced because the decision advantaging the Philippines has already been rejected by China. It, however, may be as a reference for some states to negotiate, since an optimistic atmosphere emerges among the disputing parties. The readiness for negotiation among them clearly requires that parties should not have rigid attitudes but should show flexibility based on the reciprocity principle. On one side, the PRC should set aside its typical intention to dominate most parts of the South China Sea as its traditional fishing ground based on historic rights concerning the 9-DL. On the other side, the Philippines should guarantee the regional stability and peace without questioning the real sovereignty of the PRC over several natural features, possibly related to the 9-DL claimed as its historic rights. The 9-DL is incompatible with the UNCLOS.
