본 연구의 목적은 다문화가족지원법 법안 네트워크의 구조적 변수와 가설검증에 기초를 두고 공동발의 네트워크 존립에 대한 기여도를 알아보고자 한다. 19대 국회의원의 다문화 가족지원 관련법 발의 법안들을 대상으로 하여 지수랜덤그래프모형(이하 ERGM)을 활용하였다. 본 연구에서는 국회 의안정보시스템을 통해 정보를 활용하였다. 연구결과 첫째, 호혜성 변수는 통계학으로 유의미하였으며, 연구가설과 정적인 관계를 나타내었다. 따라서 호혜성은 공동발의 네트워크 형성에 긍정적인 영향을 미친다는 것을 확인할 수 있었다. 둘째, 확산경향은 모든 모형에서 통계적으로 유의미하였으며, 연구가설과 정적인 관계를 확인할 수 있었다. 따라서 확산경향은 공동발의 네트워크 구성에 의미 있는 변수임을 알 수 있었다. 셋째, 인기도 역시 모든 모형에서 통계적으로 유의하였다. 인기도는 법안의 전문성을 고려하면 협력 네트워크 존립에 영향을 미친다는 것을 알 수 있다. 넷째, 이행성 변수는 통계적 유의성을 확보하지 못하여 이행성이 다문화가족지원법 법안 존립에 긍정적인 기여를 할 것이라는 연구가설은 기각되었다. 연구가설과 상반된 이 결과에 대해서는 향후 추가적인 검증이 이루어져야 할 것으로 보인다.

The case in this study has positive attitude in understanding the meaning of irresistible state when it comes to rape. This case offered explicit standard of cause and effect between the victim’s disability and irresistible state when offender is in charge of rape. When incidents occur, the victims are deemed able to make certain choices. Because their capacity is clearly vulnerable to external pressures and influences, and their ability to express that choice is undermined by imbalances of power in any given relationship. When the mental disabled victims do not understand what the sexual assault means exactly, it means that they do not have the power of sexual atonomy.

Since 1979, the People's Republic of China has been opeining their marke tprogressively toward all over the world for developing its own domestic economy and international trade. China also has paid a great attention to the international maritime transport due to the fact that its volume of international trade has increased continuoulsy. Under such circumstance, the Chinese Maritime Code was issued in 1992 in which the regulation with regard to carrier's liability occupied an important position. The author, therefore, selected this issue for demonstration of the legal proinciples about carrier's liability which is provided in the Chinese Maritime Code. The study on the issue is under guidance of related international conventions. On the basis of the above, the differences between the Code and relevant conventions have been pointed out in order to make the people in the field of shipping understood for legal system with regard to carrier's liability in China which is a great potential partner of Korea in shipping and trade.

The Maritime Commercial Part, which based on the CMI Conventions before 1950s, of the Korea Commercial Code has some critical issues to be improper to the morden internaitonal sea trade. This paper, therefore, has proposed a legislative policy and draft articles in order to make a reasonable and proper shipping law.
