This study identifies Kim Jihaye and Lee Jeanyoun as actor-networks with cultural values and meanings. It analyzes the process of reorganizing their works into Korean orientalism via an action of co-construction with formative techniques. First, the historical context of orientalism formed in the fashion world will be studied, followed by the design characteristics of orientalism, and the correlation between the Korean orientalism of these designers on the world stage influenced by the globalization discourse of Korean tradition since the 1980s. Next, works of Kim Jihaye and Lee Jeanyoun from 2000 to 2012 will be analyzed, revealing aspects of Korean image reproduction. Consequently, this study finds that the Korean image is restructured socio-culturally through technological imagery as a reproduction of reality by the production subject. This study reminds us of the reflective and cultural meaning of fashion designers in the area of image reproduction, sociocultural practice, and materials and technology.

Letters written in Dongba script are an important type of social documents in Dongba script. Two letters written in Dongba script to scholars have been published and translated before, but no letter of thanks written in Dongba script has been disclosed so far. This article interprets a recently written thanks letter in Dongba script, which can supplement the deficiency of such literature. From the contents of the thanks notes, it can be seen that Dongba culture has been revived in some places. In addition, some unusual writing forms of Dongba graphs appeared in this document, which can be used to supplement Dongba reference books when they are revised.

It is generally believed that the meaning of “Yi (泗)” in the Book of Songs has been nasal fluids since Mao Heng, and has been explained from the perspective of borrowing, phonetic and ideographic word-formation, etc. However, there are still seven questions about the exact meaning of “Si (泗)”, which arouses different doubts about it. From the perspectives of handed-down documents and unearthed documents, variant relationships, literary meanings, contexts, dialects and so on, the word “Yi (泗)” of “Ti Si Pang Tuo (涕泗滂沱)” should be “Yi (㳑)” meaning that the water is full and flowing out. Furthermore, “Yi (泗)” has heterogeneous relationships with “Yi (益)”, “Yi (㳑)”, “Yi (溢)”, “Yi (洫)” and “Yi (泆)”, and has homologous relationships with “Ti (涕)”, “Yi (洟)” and “Ti (嚏)”, and has an isomorphic relationship with “Si (泗)” of “Si Shui (泗水)”. These relationships can be used to collate unearthed and handed-down documents.

본 연구의 목적은 수온-염분도를 분석하여 음속최소층을 유추하는 과정을 통해 과학영재들의 그래프 해석 능력과 해양의 물리적 개념 이해 정도를 살펴보는 것이다. 이에 과학영재학교에 재학 중인 3학년 총 106명의 영재학생을 대상으로 해양학 학술지에 게재된 수온-염분도를 이용하여 SOFAR (SOund Fixing And Ranging) channel의 깊이를 추정하는 논서술형 문항을 만들어 양적, 질적 분석을 수행하였다. 연구결과 수온-염분도를 해석, 모델링, 변환하는 등 과학영재마다 그래프를 분석하는 수준에서 차이가 나타났으며 수온, 염분, 밀도 등에 관한 대안 개념도 노출되었다. 본 연구 결과는 과학영재들의 그래프 해석 수준을 이해하고, 그 과정에서 나타난 대안 개념을 토대로 해양 분야 교수-학습 방법 개선 프로그램 및 그래프 분석과 관련된 소재 발굴을 위한 기초 자료를 제공할 것이다.

본 논문에서는 양생의 현대적 해석과 한국에서의 적용을 다루었다. 앞서 진행된 한국에서의 양생 연구를 살펴보면, 양생 연구에 관심이 그리 많지 않음을 확인할 수 있다. 그 원인 가운데 하나는 세상은 변하는 데 양생의 의미는 과거에 머물러 있기 때문이다. 이러한 상황에서 양생 연구를 새롭게 발전 시키기 위해서 양생의 현대적 해석과 한국에서의 적용을 탐구해 보았다. 먼저 ‘양생의 현대적 해석’에서는 고대 양생의 의미를 기초로 양생의 현대적 계승을 알아보았다. 특히, 현대 과학의 발전과 인식의 변화에 따른 양생의 온고지 신을 강조하였다. 동시에 현대인들은 새로운 양생을 원하고, 이러한 측면의 양생은 생활 속에서 다양하게 존재하고 있음을 제시하였다. ‘양생의 한국적 적용’에서는 양생의 현대적 해석을 기초로 한국 사회에 적용할 방향을 모색하였다. 한국 사회의 경제적 발전은 많은 분야에 영향을 미쳤고, 양생의 현대적 적용이 필요함을 감지할 수 있다고 보았다. 본 연구를 통해 필자는 종교와 사상은 당대 사람들의 문제에 귀 기울이고 이에 대한 대응을 적극적으로 하면서, 삶의 방향을 제시해야한다고 설파하였다. 그러므로 이러한 길에서 양생도 끊임없이 현실의 목소리에 귀 기울여 새롭게 탄생해야 함을 강조하였다.

19세기 말 20세기 초, 민족주의의 발현과 함께 유산은 본격적으로 국가의 보호를 받기 시작 하였고, 20세기 중반 유네스코의 탄생과 더불어 인류의 자산으로 국제적인 보호를 받았다. 그리고 20세기 후반 문화유산학이라는 독립 학제의 탄생과 더불어 유산의 담론이 학문적으로 형성되었다. 이에 따라 유산은 과거에서 발견된 문화적 산물에서 시대의 요구에 따라 선별되고 형성되는 사회적, 인류학적 과정이라는 개념으로 발전하였다. 그리고 유산에 대한 관점과 해석이 다양화되어, 유산은 국가 건설에 있어서, 국가의 정체성을 형성하는 핵심 내러티브의 중추 역할을 하게 되었다. 그리고 국제 관계에서 외교적 무기이자 소프트 파워로서 세계에 각 나라의 역사적 당위성을 전달하는 역할까지로 확대되었다. 최근에는 유산이 개인의 삶과 더욱 깊이 연관되면서 그 역할이 치유와 사회적 웰빙 매개체로서 발전하는 추세이다.

There are only residual words in the fragments or those mixed with two recognizable whole words. It is very difficult to restore the word if there is only an unrecognizable residual word. However, the residual words mixed with one or two whole words can be restored by comparing them with other glyphs appearing in Huayan Shijing (華嚴石經 ). In addition to this method, the clear whole characters in the fragments can be confirmed by the location of the Huayan Shijing, and the residual words can be restored by comparing the sentences before and after. At the same time, through this restoration method, the actual location of the fragment can also be clarified or even specified in Huayan Shijing. In the final analysis, it can be concluded that the whole word is easy to recognize while the residual piece that has the same residual character is difficult to recognize.

미국 특허법 제272조는 선박을 위시한 국제운송수단에 대하여 특허권의 효력을 배제함으로써 국제 상거래의 위축을 방지하는 목적이 있다. 이는 산업재 산권 보호를 위한 파리협약 제5조의3을 국내법화한 것으로 세계 각국 특허법 역시 비슷한 내용을 규정하고 있음에도 미국 특허법 제272조의 해석이 중요한 이유는 미국이 각국의 특허법 해석과 국제 상거래에 미치는 영향이 크기 때문 이다. 미국은 연방대법원의 Brown 판결로 국제운송수단 특허권 제한법리가 이미 있었고 제272조 신설 이후에는 National Steel Car 사건 등 그 적용이 문제된 여러 재판례가 있다. 이를 통해 미국 특허법 제272조의 5가지 요건 즉, (1) 선박 (vessel), 항공기(aircraft), 차량(vehicle), (2) 상호주의, (3) 일시성 또는 우발성, (4) 운송수단의 필요에만 발명의 사용(전용성), (5) 미국에서 판매 청약 또는 판매되거나 판매될 것의 제조에 사용되거나 미국에서 수출되지 않을 것 등의 구체적 해석론을 제시할 수 있다.

The Foreign Investment Law of the People’s Republic of China has attracted great attention worldwide since its adoption on March 15, 2019, and will come into force on January 1, 2020. This law can be regarded as the most important law of China in the field of foreign investment since China’s accession to the World Trade Organization. The legislation process of the foreign investment law of the People’s Republic of China has expressed the strong will of the Chinese legislature in amending and perfecting the legal system. The implementation of this law will positively impact the future investment environment of China. This article analyses the background and evolution of the legislation procedure, the highlights and features of the law compared with earlier related laws in the field of foreign investment of China, and the impact and insufficiency of the law, together with the issues following the implementation of the law.

‘서자여사(逝者如斯)’는 공자가 시냇가에서 흐르는 물을 바라보며 탄식하였다는 ‘천상지탄(川上之嘆)’으로 알려져 있는데, 주자는 무이구곡(武夷九曲) 제6 곡의 바위에 이를 새겨놓았다. 이 글의 의미를 두고 많은 학자가 다양한 해석을 내렸다. 맹자는 이 의미를 근원이 있는 것과 근원이 없는 것과의 비교로 이해하 고 군자가 근본 덕성과 자질이 부족한데 명성만 높은 것을 경계하는 글로 여겼다. 황간은 ‘서자’의 의미를 흐르는 세월로 보아 인생의 흘러감도 덧없음을 탄 식한 것이라 해석한다. 정(程)ㆍ주(朱)의 해석은 ‘서자’를 도(道)의 본체로 보는, 더욱 근원적인 시각이다. 정약용은 ‘서자’를 인생으로 해석하는 독특한 해석을 내린다. 본고에서는 ‘서자’의 의미를 주자가 가장 공자의 본의에 맞게 해석했다고 보고, 그 해석은 대순사상의 성(誠)의 의미와 궤를 같이 한다고 본다. 대순사 상의 성(誠)의 의미를 도즉아(道卽我) 아즉도(我卽道), 심령(心靈)의 통일, 유기 심즉유지(有其心則有之) 무기심즉무지(無其心則無之), 정성(精誠)의 네 가지 국면으로 살펴본다.

The syntax of each chapter of 《The Analects of Confucius》 has many different interpretations over a long period of time. For example, there are many different interpretations in the parts saying “If you earn something that's not a moral, you don't leave it” and “It's good to learn without words, and what's not satisfied with learning, and the lazy teaching? What will I do?” In the mentioned phrases, “earn” means “earn from listening” and “What will I do?” means “What kinds of difficulties would there be?” This book tries to explore the real meaning of 《The Analects of Confucius》 by analyzing the mentioned sentence. There are various interpretations for 《The Analects of Confucius》 and other classical pieces. And those interpretations leave readers confused of Kongzi’s ideas. This comes as limitation of interpretation of the classics. Researches done by Yangshuda and Yangbojun combined traditional Sohak (Chinese Elementary Learning) and modern linguistics and decoded many phrases. The present writer also believes phrases in the classics can be solved by studying traditional Sohak, or characters, exegesis and phoneme in conjunction with modern linguistics theories.

개혁개방이후 중국은 경제적 발전에 따라 사회적 갈등과 경제적 분화가 급속히 일어났다. 그 중에서도 소유형태의 허용으로 인한 도시와 농촌간의 격차, 기업 간의 격차 등이 생기면서 중국은 새로운 갈등문제가 경제속도에 상응하면서 발생하게 된 것이다. 특히 농촌에서의 도시로의 진입은 사회 계층구조에 급격한 변화를 발생시켜서 도농간의 격차와 함께 경제적 격차와 사고적 갈등을 일으키게 되었다. 이러한 문제들이 현저하게 발생하게 되자 많은 중국의 젊은 감독들이 그동안 소외되어 왔던 도시 빈민들, 농공민, 방황하는 젊은이들을 소재로 영상으로 담아내었다. 특히 이러한 문제의식에 깊이 있는 성찰로 사회적, 계층적 갈등문제를 국제적으로 다루고 있는 감독이 지아장커(賈樟柯) 감독이었다. 그는 그의 영화들 속에서 그 의미들을 우리들에게 심각하지 않으면서도 신랄하게 전달해주고 있다.

Wu Wu dialect; late Qing Dynasty; interpretation on The Sacred Edict; function words; colloquial words dialect translation of The Sacred Edict was written in colloquial and dialectal Chinese. Function words in the book reflected the lexical and grammatical features in Wu dialect during late Qing Dynasty, including prepositions (ex. Da), modal particles (Lao), negative words (Fu, Wu), etc. This article explores these features through the comparative analysis of the other two editions. Based on the depictions and discussions of function words, the paper provides evidence and supplements for studies on the function words of Wu dialect in the late Qing period.

This paper makes a comprehensive investigation of the New Edition of Copying and Interpretation of Yin Ruins Characters, and finds that there are still some problems in it, such as the unreliability of the character interpretation, the lack of interpretation, the errors in sentence breaks and inaccuracy of annotation. The publication of this book is of great value in the field of oracle bones, and although it has some minor flaws, it does not prevent it from becoming an authoritative work.

The current study investigates how retailers deal with sustainability issues in different market fields with a specific focus on fashion industry. This work examines the last ten years of the scientific literature on sustainable retailing (SR), through a systematic literature review. 215 papers selected from the EBSCO database are analyzed, in order to develop an overview on the state of the art of research on SR. A comprehensive framework for a holistic definition of SR and for retailers’ practices related to sustainability is outlined. Future research directions on SR are provided.

본 논문은 세계화된 오늘날 사회에서 정체성이 가지는 의미를 재고하고 문화에 내재하는 인종주의와 타자화 메커니즘을 고발하는 지미 더럼의 작품을 분석한다. 더럼은 1980년대 말부터 등장한 뉴욕의 행동주의 미술을 기술하는 과정에서 미국 원주민을 대표하는 예술가로 분류되었고, 그의 작품 역시 미국 원주민 미술로 여겨졌다. 그러나 작가는 그는 자신의 작업을 특정한 정체성으로 범주화하고 축소하는 것을 거부한다. 무엇보다도 그의 작업은 미국의 역사서술과 대중문화를 장악한 지배 담론의 실체를 폭로하고, 권력과 재현 사이의 관계를 드러내는 것에 주목 한다.

연구자는 아름다움(칼로카가티아)이 어둠 속에서 드러날 수 있음을 카이 닐센의 『해의 동쪽과 달의 서쪽』을 통해 심미적으로 해석하고자 한다. 고대 그리 스어인 칼로카가티아는 인간 행위의 이상향인, 아름답고 선한 것을 의미한다. 연구자는 심미적 해석을 위해 세 가지 중요한 요소로 분석하였다: 표층미학, 심 층미학, 승화미학(재구성). 칼로카가티아는 카이 닐센의 작품에서 인간의 감정을 다양한 방식으로 상호작용하게 이끈다. 그래서 그림에서 묘사된 요소들(색, 장소와 시간, 영적)을 분석하고자 한 것이고 이 점을 심미적 관점으로 재해석한다. 결론적으로, 이 연구는 칼로카가티아가 어떻게 심미적 해석을 하는데 사용 되는지, 또한 어둠의 개념을 인식하여 통합적으로 어떤 제안을 제공하는지를 보여준다.

저작권 제도를 정당화하는 이론적인 근거로 자연권 이론과 인센티브 이론이 있어 왔다. 자연권 이론은 저작권 제도에 대하여 저작자 권리 중심의 해석을 시도했고, 인센티브 이론은 저작권 제도를 창작 인센티브 보호를 통해 저작물 창작을 촉진하는 공리주의적 수단으로 파악했다. 인센티브 이론은 미국 등에서 저작권 제도의 정당화 근거에 대한 주류적인 시각이 되었지만 외적 모티 베이션을 강조하는 특유의 관점 때문에 현실과는 부합하지 않는 측면이 있다는 비판이 다양하게 제기되어 왔다. 종래 인센티브 이론에 의한 현실 분석이 한계를 보인다는 지적이 제기되면서 그 대안적 이론으로 행동법경제학 내지는 저작권 온정주의가 대 두되었다. 인센티브 이론 내지 합리적 경제인 모델에 대해 회의적인 시각을 보였던 행동법경제학 이 저작권 온정주의로 발전된 것이었다. 온정주의는 개인, 특히 저작자들의 결정에 따른 결과로부터 그들을 보호하기 위한 목적으로 개인 선택을 제한 하는 것을 의미한다. 실제로 미국과 우리의 저작권 법상에도 종래의 인센티브 이론 내지 합리적 경제인 모델로는 해석하기 어려우나, 온정주의 이론으로는 무리 없이 해석 가능한 조항들이 존재한다. 저작권 온정주의는 종래 인센티브 이론과는 다른 새로운 시각을 제시하여 저작권법을 통한 현실보완을 도모할 계기를 제공하였다는 점에서 높이 평가할 수 있다. 즉, 온정주의 이론은 일부 취약한 저작권자들을 저작권법을 통해 보호할 근거를 제시하였다. 그러나, 한편으로는 간접적 보완이라는 연성 온정주의를 넘어 직접적 보상(규제) 이라는 경성 온정주의까지 진행하는 것은 창작에 대한 개입과 시장의 왜곡이라는 부작용을 초래할 우려도 있으므로 신중한 접근이 필요하다.
