우리나라는 이제 새로운 지평을 여는 시기에 와 있다. 민영교도소라함은 민간인이 소유하거나 운영하는 교정시설을 말한다. 민영교도소 등의 설치․운영에 관한 법률에 따라 우리나라도 민영교도소를 설치․운영할 수 있게 되었다. 이젠 민영교도소의 도입 문제에 대한 논의 보다는 어떠한 운영방식을 채택할 것인가와 어떠한 제도적 지원이 필요한가에 초점을 맞추어야 할 시기이다. 이는 민영교도소의 설립 목적과 발전방안에 도달하고 확대방안을 찾고자 하는데 있어서 그 시행착오를 줄이고 어느 정도의 교정시설에 민영교도소의 양적․질적 발전을 가져올 수 있는 방안을 찾아야 할 것이다. 여기서 민영교도소의 활성화 부분과 교도소민영화에 대한 우려의 문제를 다시금 재정립하고 선진 민영교도소의 성공 사례를 통하여 우리 민영교도소의 운영방식이나 제도적 장치의 대안을 제시하는 계기를 마련하고자 한다. 이 논문에서는 외국의 선례를 통하여 우리나라에 적합한 모델에 대한 가능성을 찾아보고, 우리나라 관영교도소 및 보호관찰제도의 통계를 통하여 민영교도소의 운영에 대한 문제점을 분석하여 향 후 우리나라의 민영교도소의 효율적 운영 및 확대방안에 대하여 알아보고자 한다.

This Study deals with how the first Korean private correctional institution that is to open about three years hence from now should be operated and managed effectively. For this study, the historical trace of the privatization of corrections and the future prospects especially in the United State of America including some another advanced countries were reviewed. In addition, in order to solve the prison overcrowding problem, which is far from "UN Standard Minimum Rules for the Treatment of Prisoners", the study considers whether it is appropriate or not to execute the policy options such as the privatization of corrections and the use of alternative courses to incarceration, like the system in the advanced countries, such as the U. S., the United Kingdom and the like. In this context, the purposes of this study are to evaluate the current practices of the private prison, the beginning in our country and to make some recommendations for their improvement. And also, this study aims at offering the progressive and possible policies for the future privatization of corrections in Korea.
