기술적 보호조치 무력화 금지에 공정이용이 예외로 적용될 수 있는지, 달리 말해 기술적 보호조치 무력화 금지에 공정이용의 항변이 인용될 수 있는지 문제된다. 이에 대한 검토를 위해 구체적인 경우를 상정하여 보면, 교수나 학생 또는 그 외의 사람이 DVD를 학교에서 상영, 복제하는 것이 저작권법상 공정이용에 해당하는지, 만약 공정이용에 해당한다고 하다라도 그 DVD에 기술적 보호조치가 있는 경우, 기술적 보호조치의 무력화 금지 규정에도 불구하고 기술적 보호조치를 우회해서 상영, 복제를 할 수 있는지 하는 문제가 발생하는 것이다. 첫째, 수업 목적으로 교수가 DVD를 상영하거나 복제하는 경우와 학생이 DVD를 복제하는 경우는 제25조(학교교육목적 등에의 이용)가 적용될 수 있을 것이다. 둘째, DVD를 학교에서 상영, 복제하는 것은 제28조(공표된 저작물의 인용)의“인용”에 해당한다고 할 수 없으므로, 제28조가 적용될 수는 없을 것이다. 셋째, 제35조의 3(저작물의 공정한 이용)이 적용될 수 있는지에 대하여는 그 이용목적 및 성격, 저작물의 종류 및 용도, 이용된 부분이 저작물 전체에서 차지하는 비중과 그 중요성, 저작물의 이용이 저작물의 현재 또는 장래의 시장이나 가치에 미치는 영향을 고려하여 판단하여야 할 것이다. 현행법상으로는 공정이용의 경우에도 기술적 보호조치 무력화 금지 규정 때문에 기술적 보호조치를 우회할 수는 없다고 해석된다. 따라서 교수나 학생 또는 그 외의 사람이 DVD를 학교에서 상영, 복제하는 것이 저작권법상 공정이용에 해당하는 경우에도, 그 DVD에 기술적 보호조치가 있다면, 기술적 보호조치 무력화 금지 규정에 때문에 기술적보호조치를우회해서상영, 복제할수없을것이다. 생각건대 위와 같은 현행법은 타당하지 않으며, 공정이용의 경우 기술적 보호조치 무력화 금지 규정에도 불구하고 기술적 보호조치를 우회할 수 있도록 명문의 규정을 두어야 할 것이다.

Whether Fair Use can be applied to prohibition of incapacitation of the Technological ProtectionMeasures by way of exception is at issue. In other words, whether Fair Use can provide usersimmunity in regard to prohibition of incapacitation of the Technological Protection Measures isbecoming an issue. For reviewing this matter, the particular case can be considered as below.When professors, students or other peoples show or copy DVDs, can Fair Use be applied in thiscase? If so, Can they circumvent the Technological Protection Measures in spite of the regulation ofprohibition of incapacitation of the Technological Protection Measures? First, §25(Using for pedagogical goals) of the Copyright Act can be applied in case thatprofessors show or copy DVDs for the purpose of lecture and students only copy DVDs. Second,§28(Quotation of copyrighted works which is published) can’t be applied in this case, becauseshowing or copying is not the quotation. Third, in order to determine whether §35-3(Fair Use ofcopyrighted works) can be applied in this case, the purpose and character of the use, the nature ofthe copyrighted work, the amount and substantiality of the portion used in relation to thecopyrighted work as a whole, and the effect of the use upon the current or potential market for orvalue of the copyrighted work should be considered. Under the current Copyright Act, it is understood that even Fair Use can’t circumventTechnological Protection Measures because of legal protection of the Technological measures. Asa result, even though Fair Use can be applied in case that professors, students or other peoplesshow or copy DVDs, if the DVDs have Technological Protection Measures, they can’t circumventthe Protection Measures to show or copy DVDs because of the regulation of prohibition ofincapacitation of the Technological Protection Measures. This paper conclude that current law is inappropriate and legislation is needed to enable FairUse to circumvent Technological Protection Measures in spite of the regulation of prohibition ofincapacitation of the Technological Protection Measures.
