스포츠 중계방송의 핵심은 경기 내용의 실시간 전달이므로 시간적으로 생방송에 근접하지 않은 정보의 가치는 다른 방송물에 비하여 상대적으로 낮은 편이다. 그러나 인터넷 기술의 발달로 중계방송의 실시간 공유가 가능해지고 SNS의 파급력이 위 공유를 폭발적으로 촉진시키면서 광고주들이 평가하는 기존의 스포츠 중계방송의 가치는 위협 받고 있다. 스포츠 경기 중 리듬체조, 피겨스케이팅, 마루운동 등은 표현적 요소를 평가대상으로 한다는 점에서 저작물로 볼 여지가 있으나, 야구, 축구, 농구등의 구기종목, 레슬링, 권투, 태권도 등의 격투기 종목, 육상, 수영 등의 속도경쟁종목 등은 경기 내용에서 표현적 요소를 발견하기 어렵고 특정한 동작에 대하여 독점적 지위를 부여할 경우 자칫 스포츠 경기의 경쟁적 특성을 해할 우려가 있다. 한편, 스포츠 중계방송은 일반적으로 촬영 대상의 선정, 화면 구도∙배치∙분할, 리플레이 등 기술적인 카메라 동작에 기반하여 실시간으로 구성과 편집이 이루어지고, 이러한 구성과 편집은 단순한 기술적 동작을 넘어 표현의 영역에 해당하며, 해설자의 경기 진행 상황에 관한 평가, 분석, 전망이 덧붙여짐으로써 단순한 사실관계 전달 이상의 의미를 지니므로 다른 방송물과 마찬가지로 창작자의 지적, 정신적 활동이 표현된 결과물로 볼 수 있다.
