한국에서의 인터넷 규제와 표현의 자유 - 포털 규제의 문제점을 중심으로 -
Regulation of Internet and Freedom of Expression in Korea - Focusing on the Problems of the Regulation of Internet Portals -
최근 몇 년 동안 한국 사회에서 인터넷을 둘러싼 규제와 관련하여 최대의 논쟁의제로 설정되어 있는 것이 소위‘포털(portal site)’규제의 필요성과 정당성의 문제이다. 이러한 포털규제와 관련된 사회적 논란은 소위‘포털의 사회적 영향력’과‘포털의 사회적 책임’에 관한 담론에서 출발하여, 현재의 상황에서는 법률, 법원의 판결 등 법제도적인 차원의 문제로 비화되고 있다. 이 글은 최근 몇 년 동안 한국에서 논쟁이 되고 있는 포털규제와 관련하여 몇 가지 문제제기를 함으로써, 포털규제담론이나 법제도화의 내용과 방향성에 대한 의문을 제기하는 것을 그 목적으로 하고 있다. 구체적으로 포털규제 관련 입법안, 포털의 법적 책임 범위에 관한 법원 판결들, 포털규제와 관련된 현행 법제도 중 인터넷 실명제를 분석대상으로 설정하고, 한국의 인터넷 규제시스템이 기본적으로‘봉건제형 인터넷 규제시스템’에 해당한다는점에서 출발하여, 최근 진행되고 있는 포털규제의 법제도화의 방향이나 내용이‘인터넷에 대한 몰이해를 바탕으로 한 봉건제형 규제시스템의 유지’에 터 잡고 있다는 점을 밝히고 있다.
In nature, the Internet portal site is a kind of Internet Content Host(ICH). And the Internet portal site is different from a traditional press as a kind of Content Provider(CP) in spite of its news service. Therefore the distributor model should be applied to the Internet portal site. And that is global standard because of worrying over chilling effect on free circulation of information. In this context, a bill proposed by the Government which regulate the Internet portal site in the preposition that it is a publisher in the traditional meaning is based on the incorrect approach. Also recent judicial cases surrounding defamation on the Internet portal site have same problems. the cases made mistakes by applying publisher model to the Internet portal site. Consequently the cases made a fatal blunder by imposing excessive liability and general obligation to monitor on the Internet portal site as a online service provider. The basic goal of the real name identification system on the Internet is controlling expression of ideas by constructing mandatory personal identification system. In other words, the Government has an intention to remove ‘anonymity’which is one of the most characteristics of Internet coercely. In this context, the real name identification system on the Internet has serious constitutional problems. Consequently, the regulation system of the Internet, especially portal site in Korea is characterized as an authoritarian regulation system.
