최근 국내외에서 온라인 뉴스에 대한 링크설정 행위와 관련하여 저작권 침해소송이 제기되는 등 이러한 링크설정행위가 온라인 뉴스 저작자인 인터넷 신문사의 권리를 침해하는 것인지 여부가 문제되고 있다. 살피건대, 링크설정행위 자체만으로는 저작권법이 규정하는 저작권 침해행위라고 보기 어렵고, 다만, 이용자가 링크된 뉴스 서비스를 링크제공자의 것으로 오인 혼동할 가능성이 인정되는 경우 상표권 침해 또는 부정경쟁행위에 해당할 수 있으며, 또한, 온라인 뉴스에 대한 링크설정행위로 인해 인터넷 신문사들의 경제적 이익이 위법하게 침해된다면 민법상의 불법행위에 해당한다고 볼 수 있을 것이나, 링크가 인터넷에서 보편적으로 행하여지는 관행이자 인터넷 이용에 필수적인 기술인 점에 비추어 위법성이 인정되는지 여부는 링크설정행위의 태양, 침해방법 등을 구체적으로 검토하여 엄격하게 판단할 필요가 있다.

The question of whether setting links to webpages of online news providers is infringment of copyright is becoming an issue recently. This paper concludes that such link setting does not compose infringement of copyright by itself, but when it is possible that readers may misconceive the service as that of the original news provider, such conduct may compose infringment of trademark rights or become an unfair competitive act. Also, when financial interests of online news providers are infringed illegally, the linker may bear liability based on tort, and the judgement of illegality should be made individually based on aspects of the link setting and manner of infringment, but since linking is practiced generally as a essential technique on the internet, such liability should not be imposed on easily.
