저작권은 저작인격권과 저작재산권으로 구성된다. 저작인격권은 저작자가 자기의 저작물에 대하여 가지는 인격적 이익의 보호를 목적으로 하는 권리로서 저작자 一身에 專屬한다는 점에서 저작재산권과 구별되며, 저작재산권이 제한되는 일정한 경우에도 저작재산권과는 달리 여전히 독자적으로 보호된다. 현재 대부분의 국가가 저작인격권을 보호하고있는데, 저작인격권에 구체적으로 어떠한 권리가 포함되는가에 관하여는 나라마다 달라 통일적으로 설명하기 어렵다. 우리 저작권법과 프로그램보호법은 저작인격권으로 공표권, 성명표시권, 동일성 유지권을 명문으로 규정하고 있다. 또한 우리 저작권법은 저작자의 생존 당시보다 더 엄격한 요건 아래 저작자 사망후에도 저작인격권을 보호하고 있다. 한편, 저작인격권은 저작물이용의 목적이나 태양 또는 저작물의 성질에 비추어 저작물의 원활한 이용이라는 공공의 이익에 부합하지 않는 일정한 경우 제한된다. 디지털기술의 발달에 따라 저작물이용자와 저작자와의 관계를 새롭게 정립할 필요성이 커지는 현재에 있어서, 이러한 제한규정을 통하여 저작물 이용자와 저작자의 이해관계를 합리적으로 조절할 수 있을 것이다.

Copyright is composed of the author’s personal rights and economic rights. The author’s personal rights protect moral benefit of a creator and belong exclusively to an author different from the author’s economic rights. Also, the author’s personal rights are still available independently of the author’s economic rights, even though the latter rights are restricted. Now most nations protect the author’s personal rights, but it is hard to describe uniformly what rights are concretely in the author’s personal rights due to the diversity of the rights according to the each nation. Korean Copyright Act and Computer Program Protection Act provide the rights to publish the work, to claim authorship of the work and to maintain the sameness of the work. Korean Copyright Act also provide for the protection of the author’s personal rights after his death under stricter conditions than before his death. The author’s personal rights can be restricted when they do not correspond with the public benefit from the harmonious uses of works. With the advance of digital technology, it is more and more important to solve conflicts between creator and user of works, and we can find the compromises reached between creator and user through the reasonable application of the restriction.
