1996년에 체결된 WCT 및 WPPT는 체약국으로 하여금 공중이용제공권을 인정할 것을 규정하고 있다. 공중이용제공행위는 기존의 복제권이나 배포권 등에 의하여서는 저작권자가 통제할 수 없는 행위에 해당된다는 것이 그 주된 근거였다. 한국의 저작권법은 1998년 컴퓨터프로그램보호법의 개정, 2000년 및 2004년의 저작권법 개정에 의하여 저작권자 및 저작인접권자에게 전송권을 인정함으로써 WCT 및 WPPT를 수용하였다. 미국은 공중이용제공행위에 대하여 특별히 입법하지 않았는데, 복제권, 배포권, 전시권, 공연권 등에 의하여 통제된다는 것이 미국의 입장인 것으로 보인다. 일본은 공중송신, 자동공중송신, 송신가능화 등의 개념을 도입하고, 유럽연합은 저작권지침에 의하여 공중이용제공권을 인정함으로써 WCT 및 WPPT를 이행하고 있다. 한국의 법원은 스트리밍 및 P2P파일교환 행위가 전송에 해당한다고 판시하거나 해당할 것이라는 것을 분명히 밝혔다. 2005년 저작권법 개정안은 방송, 전송, 디지털음성송신을 포괄하는 공중송신의 정의 신설, 방송과 전송의 구별을 확실히 하기 위한 정의의 변경, 디지털음성송신정의 신설, 현행법상의 방송권 및 전송권을 아우르는 공중송신권의 신설, 디지털음성송신에 대한 법정허락의 인정을 그 내용으로 함으로써, 기존의 공중이용제공행위에 대하여 보다 더 상세한 규정을 하게 될 것으로 보인다.

WIPO Copyright Treaty(WCT) provides that ... authors of literary and artistic works shall enjoy the exclusive right of authorizing any communication to the public of their works, by wire or wireless means, including the making available to the public of their works in such a way that members of the public may access these works from a place and at a time individually chosen by the. WIPO Performances and Phonograms Treaty(WPPT) also grants similar rights to performers and producers of phonograms. Korea implemented this obligation by amending the Computer Program Protection Act(CPPA) in 1998 and the Copyright Act in 2000 and 2004. Although the United States has not amended its Copyright Act of 1976 to implement the obligation, making available of works to the public seems to be covered by the rights of reproduction, distribution, public performances, and public display. Japan and the European Union have also implemented the treaty obligation. Korean courts have had several chances to interpret the electronic transmission right in the cases on streaming and P2P file sharing. They held that electronic transmission right is infringed or that infringement of electronic transmission is implicated in those cases. The 2005 Amendment Draft to the Korean Copyright Act would change the definition of electronic transmission, and would introduce the definition of digital audio transmission subject to compulsory licenses and public transmission.
