DRM은 저작권법에 의하여 보호되는 권리에 대하여 정단한 권리나 자격 없이 침해하는 행위를 방지하기 위하여 사용되는 기술적 보호조치이며, 디지털 환경에서 저작권에 대한 새로운 해석을 유도하고, 이를 지속적으로 유효하게 하기 위한 적극적인 수단이다. 본 논문에서는 DRM의 기술적인 요소에 대하여 기술하고, 디지털 컨텐츠의 합법적인 이용을 보호하는 DRM의 확산을 촉진하기 위한 기술 표준화에 대하여 논의한다. DRM의 확산을 이루어내기 위하여서는 무엇보다 DRM의 표준화에 있어서 개방형 기술을 채택하여 제품간의 상호호환성을 높이고 시장에서의 경쟁을 촉진하여야 한다. 또한 디지털 환경의 특수성을 이해하고, 이를 반영할 수 있는 법제도적인 뒷받침이 필요하다. 한편 국내 DRM 산업의 활성화를 위하여 솔루션 개발업체, 저작권자 및 관련단체, 컨텐츠사업자, 서비스 제공자 그리고 정책 담당기관의 광범위한 협조를 통하여 국내 기술표준안을 마련하고, 성공적인 사업모델에 기초하여 국제표준안을 제안하여 세계시장으로 진출할 수 있는 발판을 만들어 가야 할 것이다.
The Digital Rights Management is a technological protection measure that is used to protect the rights that are stated in the Copyright Act from the illegal infringements without proper permissions or requirements. The DRM is an affirmative measure that inspires a new construction of the Copyright Act and enables it to work effectively in digital age. In this paper, we explain the core technological factors of the DRM and discuss the issues of technological standard of DRM to facilitate a legal use of digital contents. At first, we should adopt the open architecture technology as the DRM standard to enhance interoperability among DRM products and to encourage the competition in the market. Moreover, we ought to change existing legal regime to support the characteristics of digital environment. On the other hand, it is a very pending task to set up the national DRM standard and it requires an extensive cooperation among stakeholders - copyright owners and associations, technology solution providers, content providers, service providers and policy makers. With the success of business model in the domestic DRM market, we shell propose our DRM standard to international standard bodies and it will be a successful support our technological products to make inroads into the global market.
