최근 휴대전화 등 다양한 전자기기의 사용이 일상화되면서 이로부터 발생되는 인위적인 전자파에 노출되는 경우가 확대되고 있다. 이와 함께 전자파의 인체에 대한 부정적 영향을 원인으로 한 법적 분쟁의 우려 또한 커지고 있다. 이 논문은 전자파가 인체나 기기 등 물적 재산에 미치는 부정적 영향에 관한 사회적 관심이 높아지고 있는 시점에서 향후 예상되는 법적 분쟁에 대한 비교법적 자료로서 미국에서의 불법행위책임 법리와 관련 사례를 검토하기로 한다. 미국에서는 우리 사회에 비해 상대적으로 전자파와 관련된 소송이 일찍부터 시작되었다. 실제로 지난 1990년대 초반부터 전자파의 유해성에 대한 사회적 관심이 높아지면서 인신손해(personal injury)와 물적 손해에 대한 손해배상 또는 금지명령을 청구한 소송이 이어졌다. 이 논문에서는 전자파의 인체유해성에 관하여 1990년대 이후 진행되었던 과학적 ․ 의학적 관점에서의 연구를 개관한 후, 전자파와 관련된 소송이 본격화되면서 법학자와 실무가 사이에서 논의되었던 불법행위책임법리를 검토하고, 이들 법리가 전자파라는 특수한 성질을 가진 유해원에 대해 어떻게 적용되었는지 살펴보기로 한다.

Modern living entails exposure to electromagnetic fields(EMFs), which are generated by various sources of electric or electronic devices. And there is growing concern that plaintiffs will bring large numbers of lawsuits alleging harm as a result of exposure to EMFs. This article explores tort theories and tort claims that were brought seeking recovery for some types of EMF-related injuries in the United States. Firstly, it surveys research into the effects of EMF exposures on the human body in the U.S. However, the current science may not be able to provide conclusive answers to the question of causation. Secondly, it identified the personal injury litigants, and set forth the elements of the plaintiff's prima facie case for negligence, product liability, and strict liability in the EMF context. However, EMF personal litigations have been marked by defense victories because the current state of the scientific evidence is inadequate to support the plaintiffs burden of proving the existence of a causal connection between EMF exposure and various diseases. Thirdly, it examined the plaintiff's case for damage to land under tort theories of trespass and private nuisance. It also examined how the theories were applied in cases. Although property-based claims have been frequently brought in EMF-suits, such claims have not been met with great success in EMF litigation. Resolution of tort claims in the EMF context are exceedingly complex. Despite prevailing uncertainty regarding whether EMFs do in fact cause health risks, litigants will bring their claims to court.
