정보통신의 발전에 따라 야기되는 기본권상의 문제점은 한편으로는 헌법상 통신의 자유의 주요한 내용이 되면서 동시에 사생활의 비밀의 자유 및 개인정보보호와 함께 표현의 자유 문제까지 아우르는 것이다. 통신의 자유 보호가 새로운 환경에서 적극적으로 이루어지고 있는지 관련 법체계를 검토해 보아야 하는데 통신비밀보호와 연관된 가장 중요한 법률은 통신비밀보호법이다. 한편으로는 정보화시대의 변화된 상황에 맞게 통신의 자유를 비롯한 기본권을 효과적으로 보호하면서 다른 한편으로는 첨단 범죄에 효율적으로 대처한다는 현실적 필요도 소홀히 하지 않는 법적 장치를 마련할 필요가 있다. 본 논문에서는 이러한 내용을 포함하여 통신비밀보호법상 논의되는 문제점 몇 가지에 대하여 감청을 중심으로 검토한다.

The problems raised with the development of communications mainly regard freedom of communication in the Constitution, but at the same time it is critical substance of the secrecy and freedom of privacy and the protection of personal informations; furthermore, it comes down to the problem of freedom of expression. Whether the freedom of communication is actively protected under new circumstances must be examined according to the law system under the Constitution, and the most important law regarding the protection of communications secrets is the protection of communications secrets act. It is necessary that legal system-which on the one hand effectively protects the fundamental rights including freedom of communication according to the new environment, and on the other hand deals with high-tech crimes efficiently-is provided without neglect. Including these matters, this thesis examines a few problems discussed about the protection of communications secrets act focusing on interception.
