금치산 혹은 한정치산 제도는 노인이나 장애인으로 하여금 그들의 능력을 제한하고 낙인을 주기에 그 역할을 제대로 하지 못했다. 이에 2011년 민법개정을 통해 성년후견제도가 도입되었는데, 이 제도는 클라이언트의 자기결정권과 잔존능력의 존중, 정상화 등을 기본 원칙으로 하고 있다. 이에 본 연구는 성년후견제도의 목적, 본질 그리고 개념을 살펴보고, 이러한 성년후견제도가 사회복지분야에서 정착이 되려면 어떠한 준비를 해야 하고 어떠한 절차를 통해서 성년후견제도를 적용될 것인지 고찰하는 것을 목적으로 한다. 결국, 사회복지사는 노인과 장애인 등 성년후견제도를 통하여 그들을 지원하기 위해서는 그들이 소유하는 권리에 대하여 옹호자, 행정가, 그리고 사례관리자의 역할을 수행할 수 있도록, 법적 지식, 기술 등을 습득해야 할 것이다.

As the purpose of declaring the old or the disables is to protect those lacking the ability to handles their affairs due to mental incapacity. Therefore, with the revision of the civil code in 2013, the new guardianship system was introduced which code is to respect self-determination and respect of capability, normalization for clients.Therefore this study is to provide the purpose, essence, conception of the newly- introduced adult guardianship system. And What fields of Social Welfare should prepare, what kinds of legal processing for successful implementation. Finall, Social Workers have to prepare about legal knowledge, skills in order to perform of keeping their right as advocator, administrator and case manager through guardianship.
