인터넷과 디지털사회의 축복을 경험하면서 우리사회에 던져진 고민거리 중 하나는 단연 저작권 문제가 아닐까 싶다. 저작물，저작권이 무엇인지 알 필요도 없었던 시대를 살아왔던 우리사회는 2000년을 전후로 불과 10여년 동안 참으로 다양한 저작권 이슈를 경험하였다. 저작권자의 권리강화와 위반자에 대한 처벌, 그리고 매개자·이용자들의 대응 속에서 우리 사회구성원은 너무 많은 소모적 분쟁에 시달려야 했다. 이제는 그와 같은 구시대적인 패러다임에서 벗어나야 할 필요성에 많은 사람들이 공감하고 있다. 산업과 사회발전의 핵심가치가 지식정보 중심으로 이동하고 있는 현실에서 저작권 문제가 사회적인 합의에 따라 바람직하게 해결만 할 수 있다면 그것이 결국 산업적인 발전과 직결될 수 있으므로, 마음 놓고 저작물과 콘텐츠를 이용할 수 있는 합법적인 유통 시장을 더 많이，더 다양하게 마련하기 위하여 필요한 노력을 다하는 것으로 패러다임의 전환을 시작하고자 하는 것이다. 이러한 패러다임 전환의 전제적 기반이 되는 사항이 바로 권리의 존부와 소재파악에 대한 공적확인과 관련된 사항이다. 저작권의 소재를 확인할 수 있는 방법이 개선된다면 저작권 시장의 안정성과 신뢰성 효율성을 제고할 수 있다. 우리 나라에서는 2006년 12월 저작권법에 ‘권리자 등의 인증제도’를 도입하여 정책적으로 대응하고자 하였다. 그러나 입법 이후 3년여가 흐른 현재까지 저작권 인증제도는 오히려 다양한 고민거리만 확인한 채 명확히 정착되고 있지는 못한 상황이다. 따라서 본고는 저작권 인증제도에 대한 이해를 도모하면서， 현재 제도가 가지고 있는 문제점을 검토해보고 이에 대한 개선방안에 대해 제언하고자 한다.
One of the questions that are now being faced by our society which is blessed with the Internet and digital technology seems decisively to be copyright issues. Indeed, our society which lived in times where there were no needs to know about works and copyrights has begun to experience various copyright issues since the last decade about 2000. The members of our society had to be suffered from too many consuming debates in the midst of the reinforcement of copyright holders' rights, the punishment against violators and the actions of meditors and users. Today, most people agree with that it is necessary to break such a paradigm of the old days. In the reality where core values of industrial and social development are moving based on knowledge information, copyright issues would be directly connected to industrial advances, only if it could be solved desirably according to the social consensus. Hence, a paradigm shift can begin with the efforts to make more and diversified legitimate distribution markets where one can use works and contents freely. The premise of this paradigm shift is associated with the authorized confirmation of understanding of the existence and presence of rights. If ways to identify the presence of copyright are advanced, the stability, reliability, and effciency of copyright market can be enhanced. In Korea, a certification system for copyright holder, etc. has been introduced into copyright law in December 2006 as policy responses to copyright issues. The certification system, however, has only found various questions and not clearly became established even to the present three years passed since the enactment. Therefore, this study examines the problems of the current system and suggets how to improve them, while encouraging the understanding of copyright certification system.
