According to the increasing importance of the trade secrets, legal regulations of the trade secrets have become the significant legal issue around the world. Legal regulations of the trade secrets include various substantial, procedural legal issues with regard to the standards and methods of protection. Identifying these issues and drawing an rational alternatives are the essential works for designing legal framework of the trade secrets.
In that context, Study on Trade Secrets and Confidential Business Information in the Internal Market of EU Commission in 2013 will be an informative reference for designing legal framework of the trade secrets. In that study, the present EU legal framework on the trade secrets and the fragmentation of that framework is analyzed, and legal frameworks of US, Switzerland, Japan are examined by comparative legal research. Combining above all substances, this study suggests the rational alternatives for designing legal framework of the trade secrets in EU internal market.
In Korea, trade secret protection law has some provisions on the definition of the trade secrets and civil remedies for infringement of trade secrets, which constitute the basis of legal framework with regard to the protection of the trade secrets. It will be worthwhile to review EU legal framework on the trade secrets by comparative research for developing relevant Korean legal framework.
