진보성은 특허제도의 근간 및 목적과 가장 관련이 깊은 특허요건이라고 할 수 있을 뿐만 아니 라, 특허요건 중 가장 중요하고도 판단하기 어려운 것이라는 데에 별다른 이견이 없다. 그런데 특허법 제29조 제2항은 ‘특허출원 전에 그 발명이 속하는 기술분야에서 통상의 지식을 가진 자가 선행발명에 의하여 용이하게 발명할 수 있는 것일 때에는 특허를 받을 수 없는 것’으로만 규정하고 있을 뿐이어서 법원의 판례를 통한 법 해석에 의해서 구체적인 기준을 제시하는 것은 매우 중요하다고 할 것이다. 본 논문에서는 발명의 진보성 판단 기준과 관 련한 국내외의 그동안의 논의를 전반적으로 살펴봄과 아울러 이러한 기준을 구체적으로 적용 내지 운용하는 것과 관련하여 실무상 개선하여야 될 사항을 함께 논의해 보았다. 구체적으로, 제2장(Ⅱ)에서는 미국, 유럽, 일본 등 다른 나라에서의 발명의 진보성 판단 기준을 소개하였다. 제3장(Ⅲ)에서는 진보성 판단의 대상이 되는 특허발명의 특정에 관한 논의를 진행하였다. 제4장(Ⅳ)에서는 진보성 판단에 있어 특허 발명과 대비되는 선행기술의 특정에 관한 논의를 진행하였다. 제5장(Ⅴ)에서는 진보성 판단에 있어 판단의 기준이 되는 ‘통상의 기술자’에 관한 논 의를 진행하였다. 제6장(Ⅵ)에서는 진보성 판단 작업에 있어 가장 핵심적인 부분이라고 할 수 있 는 용이 도출 여부에 관한 논의를 진행하였다. 또 한, 앞서의 논의를 기초로 바람직한 진보성 판단 기준 및 방법의 정립을 위한 개선방안을 제안해 보았다.

Inventive step is the most fundamental requirement related to the purpose of patent system and the most difficult requirement to determine. The Article 29(2) of the Patent Act sets forth below: Where an invention could easily be made prior to the filing of the patent application by a person having ordinary skill in the art to which the invention pertains, on the basis of the prior art, no patent shall be granted for such invention. In this reason, it is very important to present the specific criteria through case law. In this paper, I examined the various issues related to the criteria of inventive step and the reasonable solution to the practical problems occurred from inventive step determination. In chapter 2(Ⅱ), I examined the criteria of inventive step determination in foreign patent systems such as USA, Europe, Japan. In chapter 3(Ⅲ), I examined identifying the claimed invention as the object of inventive step determination. In chapter 4(Ⅳ), I examined identifying the prior art compared to the claimed invention. In chapter 5(Ⅴ), I examined issues related to a ‘PHOSITA’ as the standard of inventive step determination. In chapter 6(Ⅵ), I examined the determination whether it is easy or not for a PHOSITA to reach the invention, which is a core problem in the inventive step determination. Furthermore, I suggested the several ideas on the inventive step determination in the light of enhancing objectivity and predictability.
