대표적인 사회적 약자인 장애인들은 범죄의 표적이 되어 가장 기본적인 생존 및 안전의 문제를 위협받는 경우가 많다. 이 글은 발달장애인에 대한 범죄의 심각성을 알리고 범죄 발생의 맥락을 파악하여 범죄피해 예방을 위한 조치들을 마련하기 위한 탐색적 연구이다. 범죄피해에 가장 취약하다고 볼 수 있는 발달장애인 을 중심으로 범죄피해와 관련된 위험 요소들을 탐구하고 이해하는 작업에 초점을 맞추었다. 장애인 대상의 범죄는 반복성, 장기성, 비가시성 등의 특성을 가지고 있으며, 장애의 직접효과, 사회적으로 매개된 장애의 효과, 피해의 촉진, 피해의 유인, 인식된 취약성 등이 범죄피해의 중요한 요인이 되고 있다. 범죄는 가해자, 피해자, 환경의 상호작용 속에서 발생한다. 사회적 관심의 확충을 통하여 장애인 범죄 피해의 가시성을 높 이고, 관련 정보를 축적하고, 위험 요소를 확인하는 등 계속적인 노력이 필요하다. 범죄피해를 최소화하는 실천적 조치를 마련하는 것은 사회적 약자의 삶의 질을 향상시키기 위해서 뿐만 아니라 전체 사회의 질을 높이기 위해서도 반드시 요청되는 작업이다.

People with disabilities who are socially disadvantaged are often the targets of crime and are not guaranteed the most basic survival and safety needs. This article is an exploratory study to inform the seriousness of crimes against persons with developmental disabilities and to identify the context of crime occurrence and to prepare measures for crime prevention. In this study, I attempted to understand the risk factors related to crime victimization, especially those with developmental disabilities.
The crime against persons with disabilities has characteristics such as repeatability, long-term, and invisibility. The direct effects of disability, the effects of socially mediated disability, the precipitation and attraction of victim, and the perceived vulnerabilities are important factors of victimization. As the victimization occurs in the interaction of the perpetrator, the victim and the environment, it is necessary to accumulate more information through the expansion of social interest, to increase the visibility of victims of crime and to identify risk factors. Measures to minimize crime damage are required not only to improve the quality of life of the socially underprivileged but also to improve the quality of the whole society.
