노인범죄가 관심의 대상이 된 것은 오래된 것이 아니다. 국가의 범죄통제정책은 대체적으로 민생치안이나 흉악범죄에 집중되어 있었고, 범죄자의 특수성을 고려하여 관심을 가진 것은 소년범죄에 한정되어 온 것이 고작이라고 할 수 있다. 그러나 최근 한국사회가 급속히 고령화되면서 노인범죄도 동반 증가하고 있고, 머지않아 인구의 상당한 비율을 차지하는 베이비 붐 세대가 고령화 대열에 합류하게 되는 시점에서 노인범죄가 심각한 사회문제가 될 것이라는 것을 예측할 수 있다. 종래 노인은 범죄의 피해자로 인식되어 왔고, 설령 범죄의 행위자가 노인일지라도 고령화에 따르는 이상행동으로 여기거나, 피해가 경미하거나 그 발생빈도가 낮다는 이유로 관심의 대상이 아니었다. 문제는 최근 들어 노인범죄의 양상이 달라지고 있다는 것이다. 최근 노인범죄의 동향은 한 마디로 그 발생빈도가 높고, 흉포화 되고 있다고 할 수 있다. 이는 노인인구의 증가와 함께 앞으로 큰 사회 문제로 대두될 것인바, 본 연구에서는 이러한 노인범죄에 대한 대응 방안으로 노인범죄에 대한 국민적인 관심을 제고하여야 한다는 것을 시작으로 노인범죄 전문가 양성과 관련단체의 설립과 지원, 소년보호처우를 응용한 노인전용교정프로그램의 개발, 노인전용교정시설의 설치나 소년교정시설의 활용과 운영방안 및 가족유대강화 프로그램의 개발 등을 제안하였다. 나아가 위와 같은 제안들을 구체화 하고 정당성을 부여하기 위해 노인범죄와 관련하는 범죄의 수사와 재판 및 양형, 그리고 형의 집행과 분류, 교정처우 등의 기준을 제시할 소위 ‘고령자법’ 혹은 ‘노인법’의 제정을 주장하였다.

Traditionally, Elder's crimes are not subject of consideration. The crime-control policy has been concentrated upon stabilization of the people's livelihood and heinous criminal. Only juvenile delinquency is the subject of consideration that was taken account of offender's special characteristics. But, As the elderly population increases, the elderly crime is in the rising trend in Korea. And more, We can make estimate that elderly crime will be serious social problem. Because Baby-Boom Generation that is compose high ratio in population will be advanced age. Usual Elder's crimes has been regard as abnormal behavior of aged, and it's damage is not heavy, occurrence frequency is low. So Elder's crimes are not subject of social consideration. But Recently, actual condition of elder's crimes show that it's occurrence frequency is so high and more and more atrocious. this will be serious social problem in near future. So we should consider countermove against elder's crimes. To achieve that purpose, This study suggested recognition-diversion about elder's crimes, training for the expert on elder's crimes, organizing the group that execute prevention against elder's crimes, introducing of elderly-only program, correctional system that will be run by private and etc. Furthermore, I insisted on making laws, so-called 'Elder's Act' that has basis of investigation, trial and sentence for elder's crimes and the treatment for the elderly inmates.
