본 연구는 교정 분야에서의 자원봉사자 활용 의의를 검토한 후, 미국에서의 민간시민인력 활용 사례를 살펴보는데 목적이 있다. 응보적 교정(retributive corrections) 이념에서 회복적 교정(restorative corrections) 이념이 강조되는 현 상황에서 시민자원봉사자의 교정 참여가 어떤 방향에서 이루어져야 하는지 고민해보고, 외국의 사례를 직접 검토하여 우리나라의 활용 모델로 삼는 것은 교정의 발전을 이루는 초석이 된다고 하겠다. 우리나라에서는 자원봉사자들의 활동 분야가 크게 교화, 종교, 교육, 의료, 취업 등으로 나누어져 있고 그 속에서 상담 및 교육 등의 활동이 교정 시설 별로 다양하게 이루어지고 있다. 미국에서는 자원봉사자들이 직접 교정프로그램 인증 여부를 결정하는 주요 프로그램의 개발 정책결정 업무에 관여하기도 하고, 범죄자 리엔트리 및 피해자 지원활동 업무까지 담당하기도 한다. 무엇보다도 자원봉사자 관리 업무에 있어서, 미국의 경우 국가 주도 하의 특정 협의체가 아니라 자원봉사자들이 자발적인 지역사회 네트워크에 속하는 “자원봉사자활동 센터(Volunteer Action Center)”나 “자원봉사자 주식회사(Volunteer in Probation, Inc.)”가 주도적인 자원봉사자 관리 업무를 담당하고 있어 우리나라와 차이를 보인다고 하겠다. 영국은 특이하게도 과거에 범죄를 저질렀던 범죄자가 자원봉사자들의 상담 및 지원을 통해 새로운 교정 민간 자원봉사자로 변신하게 되는 “서비스 이용자 참여(Service User Involvement)” 프로그램이 최근 각광을 받고 있다. 이것은 과거 전과자로서 알코올 중독 치료 등을 성공적으로 잘 마친 사람이 다시 다른 범죄자들을 위한 자원봉사자로 일하게 됨으로써 새로운 시도인 자원봉사자의 활용 모델을 통한 교정의 성공 사례라 할 수 있다. 또한, 영국에서는 온라인 등을 통해 일반 시민들이 갖고 있는 교정프로그램에 대한 의견을 수집하여 사회봉사명령 집행 방식을 새롭게 결정하는 등 국민들의 교정참여를 온라인을 통해 보다 적극적으로 유도하려는 움직임도 일어나고 있다. 이와 같이 영국과 미국에서는 차별화된 새로운 시민 참여 방식을 교정 분야에 도입하여 일반 지역사회 주민들에게 교정에 대한 새로운 긍정적 인식과 관심, 책임감을 부여하는데 주력하고 있는 것을 볼 수 있다. 이에 자원봉사자 모집, 교정 홍보, 교육, 사후 인력관리 측면에서 영국과 미국이 실시하고 있는 자원봉사자 활용사례는 우리에게도 큰 시사점을 제공하고 있다.

This study aims at exploring crucial correctional programs which include partnerships with citizen volunteers in the United States and the United Kingdom. Volunteers are important resources which can bring capacity to exercise informal social control in community. Although there are numerous correctional programs that are associated with the citizen volunteer involvement, the current study focuses on introducing the most representative programs that states and UK have implemented in order to overcome challenges of government initiative corrections. One of significant advantages of this study is to help Korean government adopt the new ideas and develope innovative correctional programs which rely on citizen volunteers. In states, volunteers are able to participate in wide range of correctional activities such as offender reentry, victim support, correctional program accreditation, and offender reintegration processes through volunteer network centers. In addition, volunteer participation is reliant on the level of partnerships for financial support, case assignment, and the characteristic of relevant organizations in community. In this context, volunteer-run correctional programs of the states depend on professional citizens who acknowledge the principles of restorative justice. In UK, correctional volunteerism has a unique and long history, which is consistent with the origin of community based corrections. More importantly, the community participation has been used as a key method to control crimes by UK government. Therefore the level of commitment and satisfaction of volunteers is an important measure to evaluate the effectiveness of citizen participation in corrections. In particular, service user involvement model of UK can capitalize on the unique position that released inmates may play in correctional programs as volunteers. In Korea, partnership with volunteers in corrections is often based on weak management, tension between correctional staff and volunteers, poor training of volunteers, and ineffectiveness of citizen participation. In presenting some examples of two countries regarding citizen volunteers in corrections, this study may provide better understanding into the potential for systematic Korean model of citizen participation and mobilization in offender corrections.
