교정제도란 협의의 의미에 있어서는 비행소년이나 범죄인의 재사회화 목적 에 관련된 일련의 제도를 의미하며, 광의의 의미에 있어서는 비행소년과 범죄인의 재사회화 뿐만 아니라 그 목적을 수행하고 있는 관련조직의 기능까지도 포함하는 개념이라 할 것이다. 한 국가의 문화수준을 비롯한 그 국가의 수준은 그 국가의 교정제도 수준을 평가하여 보면 쉽게 판별할 수 있을 것이다. 그것은 어느 국가사회를 막론하고 교정분야는 그 국가사회의 인권의 사각지대이며 그 사회에서 가장 저변의 상황에 처해져 있는 분야이기 때문이다. 한 마디로 한 국가의 교정제도는 그 국가의 수준을 평가하는 중요한 척도라 할 것이다. 이러한 전제 하에 본 눈문에서는 지정학적 측면이나 정치ㆍ사회ㆍ문화적 환경이 여러모로 유사한 한국과 중국 및 일본의 교정제도를 비교ㆍ분석하고 각국 교정제도의 문제점과 발전방향을 제시하였다. 수용자의 교정처우 실태는 교도작업ㆍ교정교육 ㆍ의료처우ㆍ접견과 서신ㆍ개방처우ㆍ권리구제ㆍ상벌제도ㆍ미결수용자의처우 등을 중점으로 하여 그 실태와 문제점 및 발전방향을 모색하였다. 한ㆍ중ㆍ일 국가 교정제도의 주요 문제점은 각국 공히 민간인 교정참여제도와 교정단계에 있어서의 피해자보호제도가 미흡하다는 것이다. 또한 한ㆍ중ㆍ일 국가의 교정 제도 발전방향 중 주요 핵심과제는 일반시민의 교정참여제도 활성화를 통한 교정의 사회화 및 개방화라고 할 수 있을 것이다.

The correctional system in the broad sense includes not only the rehabilitation of juvenile delinquents or criminals, but also the function of related organization which operates the purpose of rehabilitation, while it means a series of systems regarding the rehabilitation of juvenile delinquents or criminals in the narrow sense. The level of countries including the cultural level can be easily estimated by analyzing the level of their correctional systems. This is because the corrections in every society is the dead angle zone of human right and the field which is still underdeveloped. That is to say, the correctional system is a important barometer to appreciate the level of countries. In this article, based on above suggestion, I examined the problems that commonly emerge in the correctional system of three Asian countries, Korea, China and Japan, which have a similar political, social and cultural environment. Then, I proposed improvements after analyzing the correctional system of these three countries. First, I comparatively analyzed their treatment situations for inmates after reviewing the criminal trend and the inmate's situation of three Asian countries. In addition, I explored the situation, issues and improvements of inmate treatment focusing on prison industry, education activities, remuneration, medical care, vocational training, petition system and community involvement system in the corrections. The community involvement system in the corrections is the main issue that commonly emerges in the correctional system of Korea, China and Japan. The fact that criminal victims are not fully protected in the stage of the corrections is also the main issue facing three countries. The main improvements of the correctional system of these three countries are socialization and liberalization of the corrections through activating the community involvement system in the corrections.
