독도는 1946년 SCAPIN-677에 의해 일본국 외로 규정되었다. 이 규정은 대일강화조약 등에서 최종적으로 결정될 때까지 유효하지만 강화조약은 독도에 대해 아무 것도 규정하지 않았다. 그럼에도 불구하고 한 · 일 양국 정부는 각각 강화조약에 인해 독도는 자국 영토로 됐다고 주장한다. 그러나 조약 성립 과정을 살펴보면 조약 공동초안을 작성한 영 · 미 양국은 독도에 대한 견해가 엇갈린 채였다. 따라서 샌프란시스코 강화조약은 독도의 귀속을 최종적으로 결정하지 않았던 것이며, 조약은 독도의 법적 지위에 아무 영향을 미치지 않았 던 것이다. 일본정부는 이 관점에 서서 독도를 ‘본방(本邦)’의 범위 외로 규정한 법령을 조약 후에 개정하지 않았을 뿐더러 새 법령에서도 독도를 ‘본방’ 외로 규정하였다.
그 후 일본정부는 강화조약에서 일본의 포기가 규정되지 않았던 지역은 당연히 일본에 귀속된다는 논리를 개발하였다. 그러나 독도 외에도 조약에 규정되지 않았던 섬들은 결코 일본 영토로 되지 않았으므로 일본정부의 주장은 성립되지 않는다. 예를 들어 동사제도, 센카쿠(댜오위다오)제도, 하보마이 · 시코탄 등은 조약에 규정되지 않았지만 일본영토로 결정된 것은 아니다.

Dokdo was defined outside Japan in 1946 by SCAPIN-677. This decision remained valid until it was finally decided by the Treaty of Peace with Japan, however, the Treaty did not specify anything about Dokdo. Nevertheless, the Korean and Japanese governments insist that Dokdo has become its own territory by the Treaty. While, if we look at the negotiation process of the Treaty, the US and UK that drafted the joint draft of the Treaty had different views on Dokdo. In the end, the San Francisco Peace Treaty did not finally decide on the ownership of Dokdo, and thus had no effect on Dokdo's legal status. According to this view, the Japanese government did not amend the statute that stipulated Dokdo as outside the scope of Japanese area after the Treaty, and the new law also stipulates Dokdo as “outside of Japanese area”.
Since then, the Japanese government has developed the logic that the areas of which Japanese abandonment was not specified in the Treaty naturally must be attributed to Japan. However, the Japanese government’s claims are not established, because islands, such as Dokdo, the Pratas Islands, the Senkaku (Diaoyutai) Islands, and the Habomai and Shikotan were not specified in the Treaty, but were not determined as Japanese territory.
