독도는 대한민국의 영토이다. 대한민국 법령 중 독도에 관한 법령은 38개이고, 이 연구는 그 중 7개 법률에 대하여 고찰한 것이다. 독도 등 도서지역의 생태계 보전에 관한 특별법 은 1997년 12월에 제정된 독도에 관련된 최초의 법률이다. 독도의 지속가능한 이용에 관한 법은 2005년 5월에 제정된 독도를 직접 적용대상으로 한 최초의 법률이다. 이 법은 독도에 관한 기본법적인 성격을 가지고 있다. 독도의용수비대지원법은 2005년 7월에 제정된 독도 의용수비대의 대원과 유족에 관한 법이다. 그러나 이 법은 입법상의 문제로 인하여 제대로 효력을 발휘하지 못하고 있는 실정이다. 생물다양성 보전 및 이용에 관한 법은 UN의 생물 다양성 협약에 따라 2010년 10월에 제정된 법이다. 이 법은 독도의 자원을 반출하는 경우에 형사처벌하는 규정이 있다. 도서개발촉진법은 독도와는 관련이 있으면서도 관련이 없다고 할 수 있는 법이다. 문화재보호법은 독도를 문화재로 취급하여 우리가 접근할 수 없도록 하여 독도를 보호하려고 하는 법이다. 독도는 우리나라의 자존심이고, 일본이 호시탐탐 노리고 있는 우리의 영토이다. 독도는 우리나라 성문법령에 의해서 우리가 쉽게 접근할 수 있으면서 영유권을 주장할 수 있도록 독도기본법을 제정하여야 한다.

Dokdo is a territory of the Republic of Korea. This paper studies the legislation of the Republic of Korea applied to Dokdo. There are 38 Acts concerning Dokdo, and this paper covers 7 out of 38 Acts. Special Act on Ecosystem Preservation in Island Areas including Dokdo Island is the first Act that dealt with Dokdo, established on December 1997.
Act on the Sustainable Use of Dokdo Island is the first Act that directly applied on Dokdo. This Act has features of the fundamental law. Support for Dokdo Volunteer Defense Team Act is an Act for members of Dokdo Volunteer Defense Team and the bereaved, established on July 2005. But because of legislative problems, this Act is not in effective operation.
Preservation and Utilization Act on Biodiversity is established on October 2010, based on the UN Convention on Biological Diversity. Due to this Act, people who carries out natural resources of Dokdo are subjected to criminal punishment. Islands Development Promotion Act, is a law that may or may not be considered relevant to Dokdo. The Cultural Properties Protection Law treats Dokdo as a cultural asset and tries to conserve and protect Dokdo by restricting access to it. Dokdo is a national pride of the Republic of Korea and a territory which continually has been sought by Japan. For that matter, we must legislate the fundamental law of Dokdo, so it can be easily accessed by written statutes, and to declare indisputable territorial integrity.
