2018년 4월 23일부터 27일까지 국제노동기구에서는 해사노동협약에 대한 개정안을 검토하기 위한 제3차 특별삼자간위원회 회의가 개최될 예정이다. 금번 회의에서 상정하는 주요안건은 선원이 해적, 무장강도 등에 의하여 피랍된 경우, 해당 선원 및 선원 가족들을 보호하기 위한 제도를 마련하기 위한 안건들이다. 주요 안건은 협약의 개정 여부, 해적의 정의, 선원이 피랍된 경우 임금 및 권리보호, 고위험지역의 지정, 재정보증제도의 도입 등의 내용이다. 특별삼자간위원회의 개최에 앞서 해사노동협약 작업반은 주요안건들에 대해서 논의하였으며, 논의한 결과를 바탕으로 선박소유자그룹의 대표와 선원 그룹의 대표가 각각 의견을 제시하였다. 언제나 그러하듯 노·사 양측의 의견은 대립을 이루고 있다. 이 논문에서는 특별삼자간위원회 회의를 위한 작업반의 보고서와 각 단체가 제출한 주요 안건들에 대해서 검토하고, 우리나라의 대응방안을 제안하고자 한다.

From April 23 to 27, 2018, the International Labor Organization will hold the third Special Tripartite Committee for the revision of the Maritime Labor Convention. The main agendas proposed by the Special Tripartite Committee are the measures to be taken in order to protect the seafarers and their families when seafarers are abducted by pirates. The major agendas are the revision of the Convention, the definition of pirates and armed robbery against ships, the protection of wages and rights when seafarers are abducted, designation of high risk areas and the introduction of financial securities. Prior to the holding of the Special Tripartite Committee, the Maritime Labor Convention Working Group discussed major agendas and based on the results of the discussions, the representatives of the shipowners' group and the representatives of the seafarers group submitted their opinions. As usual, the opinions of both sides are splitted. In this paper, it is intended to review the final report of the Working Group for the Special Tripartite Committee conference and the major agendas submitted by each group, and recommend proper measures of our country in the forthcoming STC.
