산적액체위험물의 하역 운영의 안전규제와 관련하여 지속적으로 발생하고 있는 사고로 인하여 산적액체위험물 취급과 관련한 안전성 확보가 필요한 시점이다. 특히 원유운반선 우이산호 부두접촉사고, 2015년 중국 텐진항 폭발사고 및 2019년 울산 스톨트 그로앤랜드호 폭발사고로 인하여 안전관리체계에 대한 재검토의 필요성이 제기되었다. 그 가운데 중국 텐진항 폭발사고와 울산 스톨 트 그로앤랜드호 폭발사고는 주변에 미치는 영향까지 고려하게 되는 계기가 되었다.
우리나라의 경우 액체위험물은 개별업체에서 제조되어 도로 또는 철도를 통 하여 항만의 위험물 보관업체의 위험물 취급 저장시설로 이동되어 보관되었다가 선박을 통해 수출이 이루어지고 있으며, 액체위험물의 수입도 동일한 경로를 통하여 반대의 순서로 이루어지고 있다. 그런데 액체위험물의 하역 운영에 대한 사항은 선박입출항법상 자체안전관리계획제도에 의존하고 있지만, 폭발사고 등으로 사고가 지속적으로 발생하고 있는 상황에서 과연 효과적으로 안전을 확보하고 있는지 의문이다.
이 연구의 목적은 산적액체위험물 하역 운영에 관한 현황 및 문제점을 파악 하고 우선적으로 관련 법령의 개정안을 도출함을 목적으로 하고 있다. 즉, 현재 선박입출항법에 따른 자체안전관리계획제도 보다 강화된 제도의 도입 필요성이 논의되고 있으므로, 그 논의의 기초단계로 현재의 문제점을 파악하고 개선 할 수 있는 입법론을 제시하고자 한다.
It is time to ensure safety due to continuous accidents involving the loading and unloading of bulk liquid dangerous substances. Especially, VLCC Wuyishan Wharf contact accident in 2014, explosion accident in the Tianjin port on 2015, and Chemical Carrier Stolt Groenland Explosion Accident on 2019 led led to the request for a review of the safety management system. The impact of the explosion on the surrounding area has been considered. In Korea, liquid dangerous substances are manufactured by individual companies and moved to dangerous goods handling storage facilities of harbors through roads or railways, and then exported through ships, and the importation of acid liquid hazardous substances is also carried out in the opposite order through the same path.
However, Matters concerning the operation of loading and unloading of liquid dangerous substances depend on the Internal Safety Management Plan under Act on the Arrival, Departure, ETC. of Ships, and it is questionable whether it is effectively securing safety.
The purpose of this study is to identify the current status and problems of loading and unloading of acid liquid hazardous materials, and first of all, the purpose is to draw up amendments to the relevant statutes.
In other words, since the need to introduce a system that is strengthened by the Internal Safety Management Plan under Act on the Arrival, Departure, ETC. of Ships is currently being discussed, the basic step of the discussion was to present a legislative theory that could identify and improve current problems.
