가짜뉴스는 우리 시대를 관통하는 핵심적인 문제이다. 가짜뉴스는 선거에 개입하고, 정치적 의사결정을 왜곡하며, 사회에 혼란을 야기하고 있다. 이에 각국은 가짜뉴스에 대처하고, 그 폐해를 막을 수 있는 여러 방안을 강구하고 있다. 그 과정에서 최근 대부분의 선진국에서는 가짜뉴스를 제작, 유포하는 사람보다는 가짜뉴스가 유포되는 매개체인 구글, 페이스북, 트위터와 같은 거대 인터넷서비스제공자의 역할과 책임을 강조하는 방향으로 논의의 초점을 옮겨가고 있다. 이 글에서는 미국, 독일, 프랑스의 가짜뉴스에 대처하기 위한 법률과 논의에 대하여 살펴보았다. 이를 바탕으로 우리나라의 현행 법제 하에서 가짜뉴스에 대한 인터넷서비스제공자의 역할과 책임, 나아가 개선방안에 대하여 검토하였다. 이미 가짜뉴스가 확산된 이후에 사후적으로 책임을 추 궁하는 것만으로는 가짜뉴스의 폐해에 대처하기 역부족이다. 사전에 가짜뉴스의 확산을 예방하기 위해서는 인터넷서비스제공자들이 적극적으로 가짜뉴스를 식별하여 차단, 삭제 등의 조치를 취하 도록 일정한 의무를 부과하는 등의 규제를 하는 것이 필요하다. 주요 선진국들의 논의를 비판적으로 검토하고, 우리나라의 법제와 현실을 고려하여 가짜뉴스의 폐해를 시정하면서도, 표현의 자유를 침해하지 않는 지혜로운 가짜뉴스 대처방안이 마련하여야 할 것이다.

Fake news is a key issue in our age. Fake news intervenes in the election, distorts political decision-making process, and disturbs the society. That’s why many countries try to seek solutions for coping with fake news. Recently, in most developed countries, the focus of the discussion on fake news is shifting from the makers and distributors of fake news to the major internet service providers such as Google, Facebook Twitter, in which fake news spreads. This paper looks into the laws and arguments for the regulation of fake news in the United States, Germany, and France. In addition, the paper examines the responsibility and the liability of the internet service provider under the present Korean laws, and researches on the reform of the laws. It is not enough to counter the harmful effects of fake news, after fake news is dispersed. It is important to impose an obligation for the internet service provider to monitor and eliminate fake news spreading through the internet service, which it provides. It is necessary to prepare the solutions, which correct the harmful effects of fake news but does note infringe of freedom of expression, by critically examining the examples of the developed countries and considering legal system and realities in Korea.
