본 연구는 속눈썹 미용 시술의 소비자 피해 양상과 이를 유발하는 제도적 한계를 규명하고, 자격 기준과 법제 분석을 중심으로 개선 방향을 제시하는 것을 목적으로 한다. 이를 위해 「공중위생관리법」, 국가기술자격제도, 시술 제품 안전관리, 소비 자 피해 구제 절차, 행정 단속 체계 등 시술 전 과정에 걸친 국내 법령 및 정책 환 경을 문헌 연구를 통해 분석하였다. 분석 결과, 현행 제도는 자격 기준의 불명확성, 위생관리 세부 규정 부재, 제품 안정성 관리 미흡, 피해 구제 절차의 한계, 행정 집 행 실효성 부족 등 다양한 취약성을 지니고 있는 것으로 나타났다. 이러한 제도적 허점은 무자격 시술, 비위생적 환경, 미인증 제품 사용 등으로 이어져 소비자 피해 를 지속적으로 발생시키는 구조를 형성하고 있다. 이에 따라 본 연구는 속눈썹 미용 시술의 특수성을 반영한 자격 기준 강화, 위생관리 규정의 세분화, 제품 안전성 관 리의 전 과정 관리, 전문 조정 절차를 포함한 피해 구제 제도의 개선, 단계적·차등적 규제 도입 등 정책적 시사점을 제언하였다. 본 연구는 기술적·미용학적 관점에 치중 한 기존 연구와 달리 법제·행정·시장 구조를 통합적으로 분석하였다는 점에서 의의 가 있으며, 후속 연구에서는 시술자·소비자·감독기관을 포함한 실증자료를 수집하고, 주요 해외 국가의 규제 모델과 비교함으로써 국내 제도의 국제적 정합성과 실효성을 높일 필요가 있다.

This study aims to identify the patterns of consumer damages caused by eyela sh beauty procedures and to examine the institutional shortcomings that lead to such damages, with a particular focus on qualification standards and legal analy sis. Through a literature review, the study analyzed domestic laws and policy en vironments covering the entire process of the procedures, including the Public H ealth Control Act, the national technical qualification system, product safety ma nagement, consumer damage relief procedures, and administrative enforcement m echanisms. The analysis revealed multiple vulnerabilities in the current system, su ch as unclear qualification standards, absence of detailed hygiene regulations, ins ufficient product safety control, limitations in damage relief procedures, and a la ck of effectiveness in administrative enforcement. These institutional gaps have c ontributed to a structure in which unqualified procedures, unsanitary environmen ts, and the use of uncertified products continue to generate consumer damages. Based on these findings, the study proposes policy recommendations including st rengthening qualification standards tailored to the characteristics of eyelash beaut y procedures, refining hygiene regulations, establishing full life-cycle management for product safety, improving damage relief systems through specialized mediatio n procedures, and introducing phased and differentiated regulations. Unlike previ ous studies that have primarily focused on technical or cosmetological perspectiv es, this study integrates legal, administrative, and market structure analyses, there by linking institutional deficiencies directly to patterns of consumer damages. Fut ure research should collect empirical data from practitioners, consumers, and sup ervisory agencies, and compare regulatory models from major foreign countries t o enhance the international consistency and effectiveness of the domestic system.
