장사법에서는 자연장 이란 화장한 유골의 골분 을 수목ㆍ화초ㆍ잔디 등의 밑이나 주변에 묻거나 해양 및 화장한 유골의 골분을 뿌릴 수 있는 시설 또는 장소가 마련된 묘지ㆍ화장시설ㆍ봉안시설ㆍ자연장지에 뿌려 장사하는 것이라고 말하 고 있다. 자연장의 방법으로 화장한 유골의 골분을 자연장지에 묻어 장사하는 것도 자연장이고, 화장한 유골의 골분을 해양 등 일정 구역에 뿌려 장사하는 것도 자연장 이라고 한다. 하지만 장사법은 해양 등 대통령령으로 정하는 구역으로, 화장한 유골 의 골분을 뿌릴 수 있는 구역에 관한 규정이 미비한 점으로 인한 문제점을 보완하고 개정할 필요성이 있다. 따라서 본 연구에서는 장사법의 자연장관련 주요내용을 살펴 보고, 장사법에서 규정하고 있는 자연장과 관련한 배경 및 문제점에 관한 사항을 고 찰한 후 그에 대한 개정방안을 제시하고자 한다.
According to the Act on Funeral Services, etc.(hereinafter referred to as the “Act”), natural burial means burying bone dust remaining after cremating human remains under or around a tree, flowering plant, grass, etc. or scattering it in the marine areas and a cemetery, crematory facility, charnel facility, and natural burial ground with facilities or locations for scattering the bone dust of cremated remains, which is performed as part of a funeral service. In the methods of natural burial, it can be said that natural burial includes burying bone dust remaining after cremating human remains in a natural burial ground as well as scattering it in designated areas such as the marine areas. However, there is a need to supplement and revise the Act due to problems caused by the lack of regulations on areas for scattering bone dust of cremated remains, as area prescribed by Presidential Decree, such as the marine areas. Therefore, this study aims to examine the main provisions related to natural burial in the Act, consider the background and issues associated with natural burial as defined by the Act, and propose revisions to solve these problems.
