사교육은 전 세계적으로 나타나는 복합적 현상이며, 국가마다 그 접근 방식이 크게 다르다는 점이 지적되어 왔다. 따 라서 각국의 다양한 규제와 정책이 사교육에 어떤 영향을 미치고, 이를 어떻게 형성하는지를 이해하는 것이 중요하다. 특히 어떤 형태의 사교육이 규제를 준수하는지, 그리고 어떤 형태가 그렇지 않은지를 명확히 구분하는 작업이 필요하다. 이러한 구분을 통해 정부, 기관, 개인, 그리고 사회가 사교육에 대한 모니터링과 감독에 효과적으로 참여할 수 있다. 본 논문은 호주와 베트남의 사교육 정책을 비교 분석했다. 법령, 행정 지침(circulars), 국가 규제 등에 대한 문헌 분석 을 활용하여 아동 보호, 저작권, 산업 및 교육 정책과 관련된 영역 전반을 검토하였다. 연구 결과, 호주의 경우 사교육에 대한 직접적인 규제가 존재하지 않음에도 불구하고 전반적인 규제 체계가 더 포괄적이고 상세한 것으로 나타났다. 반면, 베트남의 규제 체계는 공립학교 교사 및 시설(인프라) 요건과 관련하여 더욱 엄격한 양상을 보였다. 그럼에도 불구하고, 양국 모두 투명성과 책무성을 강력하게 강조하고 있다. 향후 연구에서는 이러한 정책과 규제를 기반으로, 부모·튜터·교사·학생·행정가 등 주요 이해관계자의 관점을 포함한 실증적 접근을 통해 다양한 정책과 규제가 사교육의 성격과 특성에 어떤 영향을 미치는지 규명할 필요가 있다.

Private tutoring constitutes a complex phenomenon occurring worldwide. It has been noted that approaches to the phenomenon globally vary. It is for this reason it is necessary to understand a range of regulations and policies impact on and shaping private tutoring in different nations. It is necessary to clearly delineate which forms of private tutoring comply with regulations and how, and which do not. In this way authorities at all levels, organizations, individuals, and society can effectively participate in monitoring and oversight. This article examines policies on private tutoring in Australia and Vietnam. Employing document analysis of legal texts, circulars, and state regulations, we conduct a comparative assessment across domains related to child protection, copyright, as well as commercial and educational policies. The findings indicate that the regulatory framework in Australia is more comprehensive and detailed, despite there being no direct regulations on tutoring. In contrast, the framework in Vietnam appears more stringent with respect to public school teachers and infrastructural requirements. Nevertheless, both countries place strong emphasis on transparency and accountability. Future research using these policies and regulations as a basis is recommended. Empirical approaches, incorporating perspectives from key stakeholders involved in private tutoring including parents, tutors, teachers, students, and administrators can determine how across a wide range of policies and regulations, such rules affect the nature and characteristics of private tutoring.
