The Revision of the IMO FAL Stowaway Guidelines and the Strengthening of Port Preventive Responsibilities
최근 국제 해상 이주의 급증으로 해상 안전 및 항만 보안에 대한 위험이 고 조됨에 따라 국제해사기구(IMO)는 FAL.13(42) 지침을 개정하여 밀항 관리 체계 를 정비하였다. 이에 본 연구에서는 개정 지침의 규범적 변화 양상을 고찰하고, 항만 예방책임 구조의 전환이 국제 해사 거버넌스와 국내 법제에 미치는 영향 을 분석하였다. 분석 결과, 개정 지침은 밀항 관리의 책임 주체를 기존의 선박 중심에서 다층적 거버넌스 구조로 확장하고, 예방조치를 세부적으로 구체화함으로써 사전 위험관리 기능을 강화한 것으로 확인되었다. 특히, 밀항자가 승선 한 국가(State of Embarkation)에 사건 조사 및 재발 방지 의무를 부여하고 인 도적 보호 원칙을 명시함으로써 보안 관리와 인권 보호가 상호 보완하는 규범 적 틀을 제시하였다. 아울러 이는 국제법상 상당한 주의의무(due diligence)를 실무적 차원에서 구체화하는 과정으로서 연성법(soft law)의 형식을 취하고 있 으나, 국가의 행위와 국제규범의 형성에 실질적인 영향을 미치는 규범적 기준 으로 기능하고 있음을 확인하였다. 본 연구는 한국의 항만 보안 체계가 ISPS Code 이행 중심의 보안을 넘어 예방 중심의 위험관리 체계로 전환될 필요성을 시사하고, 향후 국내 해사보안 정책의 발전 방향에 대한 정책적 이정표를 제공 한다.
In response to the increasing risks to maritime safety and port security arising from the growth of irregular maritime migration, the International Maritime Organization(IMO) revised the Revised Guidelines on the Allocation of Responsibilities to Seek the Successful Resolution of Stowaway Cases(FAL.13(42)) to strengthen the international framework for stowaway management. This study examines the normative changes introduced by the revised Guidelines and analyzes the implications of the transformation of the preventive responsibility framework for ports for international maritime governance and the domestic legal system. The findings indicate that the revised Guidelines expand responsibility for stowaway management from a ship-centered approach to a multi-layered governance framework and strengthen preventive risk management by providing more detailed preventive measures. In particular, the Guidelines assign the State of Embarkation responsibility for investigating stowaway incidents and implementing measures to prevent their recurrence while explicitly incorporating humanitarian protection principles, thereby establishing a normative framework in which maritime security and the protection of human rights are mutually reinforcing. Furthermore, this study demonstrates that the revised Guidelines operationalize the principle of due diligence under international law at the practical level. Although adopted as a soft law instrument, the Guidelines increasingly function as a normative standard that substantially influences State conduct and the development of international legal norms. Finally, this study suggests that Korea's port security system should move beyond an ISPS Code compliance-oriented approach toward a preventive risk management framework and provides policy guidance for the future development of Korea's maritime security policy.
