A Constitutional Implications of Islands - A Comparative Analysis of Constitutional Provisions in OECD Member States -
본 연구는 OECD 회원국 헌법에 나타난 섬 관련 규정을 비교헌법학적으로 분석하여 그 기능을 유형화하고, 한국 헌법에 대한 시사점을 도출하는 것을 목 적으로 한다. OECD 38개 회원국 중 헌법에 섬 관련 조항을 둔 15개국을 검토 한 결과, 섬 관련 헌법 규정은 ① 영토주권 및 공간적 범위 확정형, ② 비대칭 적 지방분권 및 자치 보장형, ③ 민주적 대표성 보장형, ④ 문화·정체성 보호 형, ⑤ 경제적 보정 및 지원형, ⑥ 대외전략 및 해양안보 기능형의 여섯 가지 유형으로 구분된다. 이 유형화는 상호배타적 분류가 아니라 하나의 조항이 복수의 기능을 동시에 수행할 수 있는 분석틀이다. 현행 한국 헌법 제3조는 섬을 영토주권의 대상으로 규율하나, 도서 지역 주민의 기본권, 실질적 평등, 지방자 치, 문화·생태적 특수성, 해양안보의 문제를 직접 포착하지는 못한다. 따라서 한국 헌법상 섬은 제3조의 영토조항에 한정하여 이해될 것이 아니라, 기본권 보장, 실질적 평등, 지방자치, 문화·생태적 보호, 해양안보가 교차하는 복합적 헌법 공간으로 재해석될 필요가 있다.
This study aims to analyze island-related constitutional provisions in OECD member states through a comparative constitutional law framework, classify their functions into typological categories, and derive implications for the Korean Constitution. Among 38 OECD member states, 15 countries with island-related constitutional provisions were examined. The analysis identifies six functional types: (1) territorial sovereignty and delimitation of territorial scope, (2) asymmetric decentralization and autonomy guarantee, (3) democratic representation guarantee, (4) cultural and identity protection, (5) economic equalization and support, and (6) external strategy and maritime security. These categories are not mutually exclusive; a single constitutional provision may simultaneously serve multiple functions. While Article 3 of the current Korean Constitution adequately addresses territorial sovereignty over islands, it does not directly regulate the fundamental rights of island residents, substantive equality, local autonomy, cultural and ecological specificities, or maritime security concerns. Therefore, islands under the Korean Constitution should not be confined to the territorial clause of Article 3, but reinterpreted as complex constitutional spaces where the guarantee of fundamental rights, substantive equality, local autonomy, cultural and ecological protection, and maritime security intersect. A staged institutional reform approach — spanning constitutional interpretation, legislative amendment, and potential constitutional amendment — is proposed to strengthen the constitutional framework for island governance in Korea.
