글로벌 해운 산업에서 선원 임금의 적기 및 전액 지급은 해상 인권 보호 의 핵심축이다. 이는 2006년 해사노동협약(MLC)이 선언한 선내에서의 인간 다운 근로 및 생활 조건에 대한 권리를 보장하는 필수 요소 중 하나이기도 하다. 그러나 임금 분쟁은 여전히 선원들의 고충 제기, 선원 유기 사건, 그 리고 국제 소송을 유발하는 가장 고질적인 원인으로 남아 있다. 이에 더해, MLC의 선원 임금 관련 규정을 회원국의 국내 법체계에 수용하는 과정에서 선진국과 개발도상국 간에 상이한 결과가 나타나고 있다. 이러한 제도적 격차는 관할권에 따라 선원 임금 보호의 실효성과 형평성을 저해하는 원인 이 될 수 있다. 이에 본 연구는 법리적 비교와 사례 분석을 결합하여 한국의 선원법과 베트남의 법체계 간 선원 임금 규정의 차이점을 분석하고, 베 트남이 선원 임금 보호를 강화하기 위해 도출할 수 있는 정책적·입법적 시사점을 제안하고자 한다.
In the global shipping industry, timely and full wage payment is the linchpin of human rights protection at sea. It is one of the elements to ensure the right to decent working and living conditions on board ship, which is declared by the Maritime Labour Convention, 2006 (MLC). However, wage disputes remain among the most persistent causes of seafarer complaints, abandonment cases, and international litigation. In addition, the incorporation of the MLC provisions on seafarers’ wages into the national legal systems of Member States has produced varying outcomes, particularly between developed and developing countries. By combining doctrinal comparison with case analysis methods, this study aims to analyze the differences in seafarers’ wage regulations between the Seafarers Act of South Korea and the legal system of Vietnam, and to propose lessons for Vietnam to strengthen the protection of seafarers’ wages, in both policy and legislative implications.
