Percept ions o f t he Purposes of Punishment and Their Det erminant s: A Comparat ive St udy of t he General Public and Criminal Justice Professionals
본 연구는 형벌에 대한 인식이 단순히 처벌의 강화나 완화에 대한 태도로만 설명되 기 어렵다는 문제의식에서 출발하였다. 형벌은 응보, 억제, 교정, 무능력화 등 다양한 목적을 지닌 다차원적 개념이며, 이러한 형벌 목적에 대한 인식은 범죄피해 경험이나 범죄에 대한 두려움 등 개인의 경험적 요인에 따라 다르게 나타날 수 있다. 이에 본 연구는 일반인 195명과 형사사법종사자 242명, 총 437명을 대상으로 일반인과 형사 사법종사자의 형벌 목적에 대한 인식을 비교하고, 집단별 형벌 목적 인식에 영향을 미 치는 요인을 분석하였다. 분석결과는 다음과 같다. 첫째, 일반인과 형사사법종사자의 형벌 목적 인식은 교정, 억제, 응보, 무능력화 모두에서 평균의 차이가 통계적으로 유의미하지 않았으며, 두 집단 모두 무능력화 목적에 대한 지지 수준이 가장 높게 나타났다. 둘째, 형벌 목적 인식에 영향을 미치는 요인은 집단별로 다르게 나타났으며, 일반인은 범죄심각성에 대한 인식 및 미디어의 범죄 이미지 수용이, 형사사법종사자는 범죄피해 두려움, 연 령, 교육수준 등이 형벌 목적에 따라 유의미한 영향요인으로 확인되었다. 셋째, 형사 사법종사자 내부에서는 교정직이 교정 목적을, 보호직이 억제와 응보 목적을 상대적 으로 높게 인식하는 것으로 나타났다. 이러한 결과는 일반인과 형사사법종사자의 평균적인 형벌 목적 인식은 유사하지만, 형벌 목적 인식이 형성되는 영향요인과 직무유형에 따른 인식에는 차이가 있음을 보 여준다. 특히 형사사법종사자를 하나의 동질적인 집단으로 보기보다 직무유형에 따른 차이를 고려할 필요가 있음을 시사한다. 본 연구는 형벌 목적에 대한 인식을 다차원적 으로 비교하고 집단별 영향요인을 분석함으로써 형사정책 수립을 위한 기초자료를 제 공하였다는 점에서 의의를 가진다.
This study was motivated by the recognition that perceptions of punishment cannot be sufficiently explained solely in terms of support for harsher or more lenient punishment. The purposes of punishment constitute a multidimensional concept encompassing retribution, deterrence, rehabilitation, and incapacitation, and perceptions of these purposes may vary according to individuals’ experiences, such as crime victimization and fear of crime. Based on this premise, this study compared perceptions of the purposes of punishment between the general public and criminal justice professionals and examined the factors influencing these perceptions within each group. Survey data were collected from 437 respondents, including 195 members of the general public and 242 criminal justice professionals. The findings are as follows. First, no statistically significant differences were found between the general public and criminal justice professionals in the mean levels of rehabilitation, deterrence, retribution, or incapacitation. Both groups showed the highest level of support for incapacitation among the four purposes of punishment. Second, the factors influencing perceptions of the purposes of punishment differed across groups. Among the general public, perceived crime severity and acceptance of crime images conveyed through the media were identified as significant influencing factors, whereas among criminal j ustice p rofessionals, fear o f crime, a ge, and educational attainment significantly influenced perceptions of the purposes of punishment, depending on the specific purpose. Third, differences were also observed within the criminal justice professional group. Correctional officers showed relatively higher levels of support for rehabilitation, whereas probation officers placed relatively greater emphasis on deterrence and retribution. These findings indicate that although the general public and criminal justice professionals share similar overall perceptions of the purposes of punishment, the factors shaping these perceptions and the patterns of perception according to job type differ between the two groups. In particular, the findings suggest that c riminal j ustice p rofessionals should not be r egarded as a homogeneous group and that differences according to job type should be taken into consideration. This study contributes to the literature by providing a multidimensional comparison of perceptions of the purposes of punishment and identifying group-specific influencing factors, thereby offering empirical evidence to inform the development o f balanced c riminal j ustice policies.
