마약류 사용자들의 교정・교화를 위한 형사정책 연구 - 최신 증거법적 쟁점과 치료적 사법을 중심으로 - KCI 등재

초록

본 논문에서는 마약류 범죄에서 나타나는 회전문 현상에 대하여 문제의식을 가지고 마약류 사용자들의 교정 및 교화에 기여하도록 형사사법절차를 개선할 수 있는 구체 적이고 현실적인 방안을 모색하고자 하였다. 이에 형사사법체계와 보건・사회서비스 간의 효과적인 연계가 중요하다는 세계보건기구 및 유엔마약범죄사무소의 원칙에 기 반하여 ① 전통적인 형벌 체계에서 보다 적법한 증거수집과 적정한 공소유지를 위한 형사정책적 대안, ② 치료사법의 관점에서 형식적이지 아니한 실효성 있는 치료가 이 루어질 수 있는 형사정책적 대안을 모색하고자 하였다. 먼저 ① 마약류 범죄의 무죄율이 일반 형사사건 무죄율의 2~3배에 달하는 현상에 대하여 마약류 범죄의 국제화, 밀행성, AI 사용의 증가와 연관된 증거법적 쟁점이 있음을 밝히고, 보다 적법한 증거수집과 적정한 공소유지를 통해 마약류 사용자들의 교정 및 교화에 기여하기 위해서 해외 소재 증인에 대한 형사사법공조 문제, 위법수집 증거 문제, AI 사용내역의 증거능력 문제에 대비할 방안들을 제시하였다. 구체적으로 공소제기 전 해외 소재 증인에 대한 연락처 등 인적사항 확보를 철저히 하는 방안, 형사사법공조절차에 관한 기재례 등 상세한 매뉴얼 마련, 중국 등 국내 단속 마약사범 이 많은 국가들과 형사사법공조 절차 원활화, <마약류 월간동향>에 매달 위법수집증 거에 관한 상세한 판례 수록 및 배포, 경찰 수사 단계에서부터 AI 사용내역에 대한 유형별 세분화된 분석 활성화를 제시하였다. 다음으로 ② 치료적 사법 관련하여서는 검찰과 법원 단계로 나누어 분석하였다. 검 찰 단계의 경우, 세계보건기구 및 유엔마약범죄사무소의 국제 기준상 마약류 사용자 별로 개별적・구체적 치료 조건 부과가 필요하고 이에 적합한 제도가 검사의 마약류 사범에 대한 조건부 기소유예 제도임을 밝히고, 그럼에도 조건부 기소유예 제도의 활 용률이 낮은 실무에 대한 개선 방안으로서 시한부 기소중지 제도의 도입 및 위임전결 규정 개정을 제안하였다. 법원 단계에서는 세계보건기구 및 유엔마약범죄사무소의 국 제 기준상 피고인의 일상적이고 비공식적인 단약 노력이 국가적 차원의 치료 개입 못 지 않게 중요한데 현 재판실무상 판결 선고 시까지 치료의 공백이 있는 문제를 짚고, 이를 해결할 수 있는 방안으로 마약류 범죄의 형사재판실무에서 대법원 양형기준상 ‘마약중독자의 자발적・적극적 치료의사’의 감경요소가 보다 빈번하게 활용될 수 있도 록 변호인의 조력 확대 및 이를 위한 국가적 차원의 일상적 치료를 도울 기관에 대한 홍보를 제안하였다.

This study is motivated by the revolving-door problem in drug-related offending and seeks concrete, practicable measures to improve criminal justice procedures that can contribute to the correction and rehabilitation of people using drugs. Accordingly, based on the WHO and UNODC principle emphasizing the importance of effective linkages between the criminal justice system and health and social services, this study sought to identify: (1) criminal policy alternatives aimed at ensuring more lawful evidence collection and appropriate maintenance of prosecution within the traditional criminal punishment system; and (2) criminal policy alternatives that, from the perspective of therapeutic jurisprudence, can provide substantive and effective treatment rather than merely formalistic treatment. First, with regard to the acquittal rate in drug-related cases, which is two to three times higher than that in ordinary criminal cases, this study identifies evidentiary issues associated with the transnational and clandestine nature of drug-related offenses and the increasing use of artificial intelligence. To contribute to the correction and rehabilitation of drug users through more lawful evidence collection and appropriate maintenance of prosecution, it proposes measures addressing mutual legal assistance in criminal matters involving witnesses located abroad, unlawfully obtained evidence, and the admissibility of records of AI use. Specifically, the study proposes thoroughly securing contact information for overseas witnesses prior to indictment; preparing detailed manuals on mutual legal assistance procedures; facilitating mutual legal assistance with countries, such as China, that frequently feature in drug-related cases; including and distributing detailed summaries of judicial decisions concerning unlawfully obtained evidence in each monthly issue of ‘Monthly Trends in Narcotics’; and promoting a more detailed, type-specific analysis of AI usage records from the police investigation stage. Second, issues relating to therapeutic jurisprudence are examined at the prosecutorial and judicial stages. At the prosecutorial stage, this study demonstrates that international standards established by the WHO and UNODC require the imposition of individualized, specific treatment conditions tailored to each drug user, and that the conditional suspension of prosecution for drug offenders is particularly well suited to this purpose. However, the system remains underutilized in practice. To solve this problem, the study proposes introducing a time-limited stay of prosecutorial proceedings and amending the delegation of authority regulations. At the judicial stage, international standards established by the WHO and UNODC recognize that a defendant’s everyday, informal efforts to abstain from drugs are no less important than state-sponsored treatment interventions. This study identifies a treatment gap in current trial practice that persists until sentencing. As a solution, it proposes promoting more frequent application of the mitigating factor recognized under the Supreme Court Sentencing Guidelines—namely, “a drug-dependent offender’s voluntary and active willingness to undergo treatment”. Accordingly, the study proposes expanding the related assistance provided by attorneys and undertaking nationwide efforts to raise awareness of institutions that can support defendants’ day-to-day treatment and recovery efforts.
