The Act on Electronic Monitoring requires prosecutors to petition the court for electronic monitoring orders based on the risk of recidivism, and accordingly, recidivism risk assessment tools are routinely used in court proceedings involving these petitions. However, it has not been sufficiently empirically verified whether these assessment results have a substantial impact on judges’ decisions regarding the imposition or the duration of electronic monitoring orders. In particular, while a specialized tool known as the Korean Sex Offender Risk Assessment Scale (KSORAS) is used for sex offenses, murder and robbery cases rely on the Korean Offender Risk Assessment System-General (KORAS-G)—a general recidivism risk assessment tool—due to the absence of offense-specific risk assessment instruments, making its influence on judicial decision-making remain unclear. Therefore, this study analyzed the independent impact of KORAS-G scores by dividing the judicial decision-making into a two-stage process: the decision to impose the order and the determination of its duration. To this end, this study utilized 242 first-instance judgments on electronic monitoring petitions involving murder and robbery cases. After controlling for offense type, respondent characteristics, and victim factors, a binary logistic regression analysis was conducted for the first stage (the imposition of the order), and a multiple regression analysis was conducted for the second stage (the d uration of t he o rder) using the subset o f cases w here t he o rder w as granted (N=114). The analysis revealed that KORAS-G scores operated differently in the decision-making processes for the imposition and the duration of the order. In the decision to impose the order, each one-point increase in the KORAS-G score was associated with a 42.3% increase in the odds of the order being granted (OR = 1.423). Furthermore, an explicit mention of mental illness in the court ruling increased the odds of imposition by approximately 5.446 times. Additionally, the likelihood of the order being granted was lower for murder cases compared to robbery cases. In determining the duration of the order, however, the effect of KORAS-G scores was not statistically significant; instead, sentence length and the presence of prior convictions had a significant positive effect. This study provides empirical evidence that while judges actively incorporate scientific risk assessment results when deciding whether to impose an electronic monitoring order, they appear to base the duration primarily on the severity of the underlying offense as reflected in the sentence imposed. The findings have important implications for the rational improvement of the recidivism risk assessment system.
