        For the past decade, there have been a lot of debates on the patentability of software inventions. Given the fact that mathematic algorithm or business methods were not patentable by themselves, there have been misunderstanding or criticism that software inventions are nothing more than mathematic algorithm or business methods and thus unpatentable. It is clear, however, that software inventions which produce technical effects or concrete and tangible results are different from mathematic algorithm or business methods themselves and thus patentable subject matter. In addition, the reality in software industry clearly indicates that investments in software development demand some incentives and legal protection such as patent rights. Another reality in software industry is patent protection sometimes hinders further software developments and future innovations. This paper tries and suggests some solutions to the negative impact of patent protection. One of solutions may be found in interpreting the requirement of non-obviousness. Statistics show that there are a lot more invalid or weak software patents than in other areas of technology. In addition to problems with patent examinations at the Patent Office, there are found substantial uncertainties of the non-obviousness test not only at the Patent Office but also at judicial courts. While the U.S. Supreme Courts reinterpreted the TSM test to strengthen the non-obviousness test, Korean courts simply did not turn to the TSM issues nor suggested any clear criteria. Problems with possible abuse of patent right in software industry may be tackled by several ways including denial of remedies against any alleged patent infringement, narrow interpretation of patent claims or limitations on doctrine of equivalents, application of antitrust law and so on. Unlike in the U.S. courts, patent right owners have not been allowed to raise the issue of invalidty in the Supreme Court dealing with patent infringements in Korea. Recently, however, Seoul High Court held that bringing a lawsuit based on an invalid patent constitutes an abuse of patent right and, thus, that remedies were not granted. Other than bringing a lawsuit based on an invalid patent, however, what else constitutes abuse of patent right? It seem also difficult to define what a patent troll is. Even if patent itself is valid and even if a patent troll is not involved, standard software such as mobile phone software which is standardized may have dominant market power and may give rise to anti-competitive business practices. In this sense, antitrust aspects of patent right becomes increasingly important in software industry.

        The purpose of patent system is to accelerate and contribute for the development of technology and industry by promoting and protecting invention and its use. But, the advent of software patent, especially business model patent, and the environment where technologies are connected with each other and too many patented technologies are involved in the development of a new product, are providing a very good play ground for patent trolls to extort large amount of damages from companies which manufacture and distribute products investing lots of resources. Patent misuse by patent trolls can result in stalling and discouraging the investment for new products, which can lead to the failure of the whole patent system. So, measures for protecting patents as well as preventing patent misuse should be considered. Patentees usually exercise their rights by seeking injunction or monetary damages, so proper exercise of their discretion by courts in issuing injunction and calculating damages is highly important for protecting patentee’s rights as well as deterring patent misuse. Courts should compare the benefits and damage for patentees and alleged infringers before issuing injunction. In that comparison, they should consider whether the related patent would be invalidated or the patentee is commercializing the patent. In regard to damages calculation, courts should keep in mind that Section 128 of Patent Act of Korea exists to prevent conferring excessive damages by setting the ceiling according to patentee’s production capacity as well as to make damages calculation easy and simple. So, courts should also consider patentee’s own intention and capability to reduce to practice the patented invention. Especially when the patented technology is related to the small portion of the infringing product, courts should consider how much the patented technology contributed in manufacturing and selling the product.

        Even though 30inch optical telescope at Kyung Hee Astronomy Observatory has been used to produce a series of scientific achievements since its first light in 1992, numerous difficulties in operating of the telescope have hindered the precise observations needed for further researches. Since the currently used PC-TCS(Personal Computer based Telescope Control System) software based on ISA-bus type is outdated, it doesn't have a user friendly interface and make it impossible to scale. Also accumulated errors which are generated by discordance from input and output signals into a motion controller required new control system. Thus we have improved the telescope control system by updating software and modifying mechanical parts. We applied a new BLDC(brushless DC) servo motor system to the mechanical parts of the telescope and developed a control software using Visual Basic6.0. As a result, we could achieve a high accuracy in controlling of the telescope and use the user friendly GUI(Graphic User Interface).

        본 연구에서는 디자인 분야에서 접근이 용이하고 자연스러운 환경 하에서 제품 사용 중 표출되는 사용자의 감성을 측정할 수 있는 방법을 제안하였다. 또한, 개발된 감성어휘 로깅 소프트웨어인 VideoTAME을 활용하여 제품 사용 중 표출되는 사용자의 감성변화를 측정하였다. 개발된 소프트웨어의 실험 진행 모듈에서는 실험 참여자가 실험실에서 자신이 태스크를 수행하였던 장면을 녹화한 동영상을 직접 재생해 보면서 자신의 감성변화를 평가할 수 있다. 실험 분석 모듈에서는 연구자가 각 태스크별로 전체적인 실험 내용을 재생하면서 실험 결과를 확인할 수 있고, 마이크로소프트 엑셀로 내보내기하여 다양한 측면에서 자료를 분석할 수 있다. 본 연구에서는 실험실에서 피실험자들이 휴대폰을 가지고 일련의 태스크를 수행한 장면을 녹화한 동영상을 VideoTAME을 통해 재생해 보면서 자신의 감성변화를 평가하게 하였다. 본 실험에서는 태스크의 성격에 따라서 표출되는 대표 감성의 종류에는 큰 차이를 찾아볼 수 없었다. 이는 태스크의 전체적인 속성 보다는 각 태스크를 수행하는 시점에서의 상황에 따라 감성의 변화가 일어나는 것이라 추측할 수 있다. 향후 보다 많은 실험 데이터와 이의 통계적 분석을 통해 제품의 사용성이 사용자의 감성에 어떤 영향을 미치는 지에 대하여 밝혀낼 수 있으리라 기대한다.

        본 논문에서는 자중이 작용하는 적층판의 변위를 최소화하는 지지봉의 개수와 위치의 최적화를 다루고 있다. 자중이 작용하는 적층판의 해석 수행 시 적층판과 지지봉, 적층판들 사이에 접촉이 발생한다. 이러한 접촉문제는 상용 해석 소프트웨어의 접촉 요소를 사용하면 쉽게 접근 할 수 있으나 상용 해석 소프트웨어는 여러 가지 접촉 상황을 모두 고려해야 하므로 효율이 떨어지며, 특정 접촉문제에서는 아주 긴 해석 시간을 요구한다. 따라서 본 논문에서는 상용 해석 소프트웨어의 접촉해석 기능 대신 선형해석 기능만을 사용하되 접촉면에 존재하는 요소들의 관계를 접촉 조건을 이용한 관계식으로 정의하여 해석을 수행하였다. 그 결과 상용 해석소프트웨어에서 제공하는 접촉해석과 동일한 결과를 도출하는데 약 30배에 해당하는 시간을 절감하였다. 그리고 이러한 해석 프로그램을 이용하여 지지봉의 개수와 위치에 관한 최적화를 수행하였으며, 그 결과 지지봉의 개수를 40% 절감하였고 그에 따른 지지봉의 최적 위치를 찾을 수 있었다.

        Translating the "Voice of Customer" into business process is critical for developing products, services, and marketing programs that satisfy customers. Quality Function Deployment(QFD) is a technique which was born in Japan as a strategy for assuring that quality is built into new products. QFD was first used in 1972 by Kobe Shipyard of Mitsubish Heavy Industrials Ltd and was then referred to as the quality tables. After QFD is proposed, it has been applied by both many large and small companies around the world. Many studies related QFD are performed till now but study related "cost-based QFD(QFCD)" hasn't been performed actively. If cost-based QFD is not performed, the produced results will be included possibility that is not significant as well as realistic. Therefore, the purpose of this study is to improve effectiveness and efficiency for product development's result through QFD by introducing QFCD's concept, performance procedure and developed QFCD Software.
